中鋁國際(02068.HK)：就合約糾紛對越煤集團提起仲裁申請獲受理
格隆匯1月13日丨中鋁國際(02068.HK)公佈，2008年7月14日，公司與越煤集團簽署了有關林同鋁土礦-氧化鋁綜合項目第9標段的EPC合同(以下簡稱涉案合同)，根據涉案合同的約定，公司負責設計、提供設備及材料、建造及安裝，保證項目符合EPC投標文件中公司所述的質量及技術要求。涉案合同約定的總包合同價款為12877.80億越南盾及3.88億美元。
公司已履行涉案合同約定的義務，2016年7月14日，公司與越煤集團確認項目竣工日期為2013年10月25日。2016年7月28日，越煤集團發出臨時驗收通知，寫明項目於2008年11月18日開工，於2013年10月25日實際竣工。2017年2月23日，越煤集團發出最終接收通知，確認公司已完全履行涉案合同項下的義務，並明確公司完成涉案合同項下義務的時間為2016年12月12日。
2017年3月29日，公司與越煤集團之間的工作紀要載明，雙方同意於2017年4月10日之前根據涉案合同製作合同最後10%結算款的結算文件並提交越煤集團，越煤集團爭取於2017年4月17日前將最後結算款支付給公司。2017年4月18日，公司及越煤集團簽署了項目結算文件，最後結算款為32,678,182美元及15,962,919,192越南盾(未含暫扣款)，到期日為當日。但越煤集團未按約定履行上述相關款項的支付義務，公司自2017年7月以來多次提出付款要求，但越煤集團仍未支付款項。
鑑於越煤集團違約並未支付到期債務，公司向位於新加坡的Singapore International Arbitration Centre提起了仲裁申請。
近日，公司收到Singapore International Arbitration Centre出具的仲裁通知書(SIAC ARBITRATION NO. 427 OF 2021)，受理了公司的仲裁申請。
公司就與越煤集團之間的合同糾紛，向SingaporeInternationalArbitrationCentre提交仲裁申請書，具體請求內容主要如下：
(一)請求裁決越煤集團向公司支付最後結算款32,678,182美元及15,962,919,192越南盾，或仲裁庭認為合適的其他金額；
(二)請求裁決越煤集團向公司按上條請求金額每月複利支付融資費(自2017年5月8日起至全部款項付清為止，按付款貨幣國中央銀行貼現率高出3%的年利率計算，並應以該貨幣支付，暫計至本仲裁書完成之日為7,738,364.84美元及5,786,695,512.81越南盾)；
(三)請求裁決越煤集團向公司支付暫扣款共9,186,436,072越南盾或仲裁庭認為合適的其他金額；(四)公司保留從仲裁裁決生效之日至實際支付日期間的、適用於暫扣款的利息；
(五)請求裁決越煤集團支付仲裁費用，包括Singapore International Arbitration Centre立案費及案件管理費，支付給仲裁庭的所有費用及支出，公司仲裁申請涉及的所有費用及支出，包括法律費用、內部管理成本及所有相關費用；
(六)仲裁庭認為合適的其他救濟。
