敏芯股份(688286.SH)：一審判決公司立即停止生產、銷售侵犯原吿歌爾相關專利的產品並賠償400萬元等
格隆匯6月14日丨敏芯股份(688286.SH)公佈，2020年4月，歌爾股份有限公司(“歌爾股份”或“原吿”)向青島市中級人民法院提起訴訟，就產品編碼為“MB50R11G”、“HVWA1823”和“MB28H12F”的產品主張公司及濰城區華陽電子科技中心侵害其第201220626527.1的實用新型專利。具體訴訟請求包括：(1)主張公司立即停止侵害原吿專利權的行為，包括停止製造、使用、銷售、許諾銷售被訴侵權產品、銷燬製造被訴侵權產品的專用模具和設備；(2)主張濰城區華陽電子科技中心立即停止侵害原吿專利權的行為，包括停止銷售、許諾銷售被訴侵權產品；(3)主張公司賠償原吿經濟損失人民幣1000萬元；(4)主張公司與濰城區華陽電子科技中心共同承擔原吿維權的合理支出人民幣50萬元。
近日，公司收到青島市中級人民法院的一審民事判決書(案號為：(2020)魯02知民初65號)。一審判決結果如下：
1、被吿蘇州敏芯微電子技術股份有限公司於判決生效之日起立即停止生產、銷售侵犯原吿歌爾股份有限公司專利號ZL201220626527.1、名稱為“MEMS麥克風”實用新型專利權的產品；
2、被吿蘇州敏芯微電子技術股份有限公司於判決生效之日起十日內賠償原吿歌爾股份有限公司經濟損失及維權合理費用共計400萬元；
3、被吿濰城區華陽電子科技中心於判決生效之日起立即停止銷售侵犯原吿歌爾股份有限公司專利號ZL201220626527.1、名稱為“MEMS麥克風”實用新型專利權的產品；
4、駁回原吿歌爾股份有限公司的其他訴訟請求。
一審案件受理費84,800元，由原吿歌爾股份有限公司負擔26,248元，被吿蘇州敏芯微電子技術股份有限公司負擔58,552元。
如不服本判決，當事人可在判決書送達之日起十五日內向青島市中級人民法院遞交上訴狀，並按對方當事人的人數提出副本，上訴於最高人民法院。
此次判決為一審判決結果，目前該判決尚未生效，公司將會第一時間依法提起上訴，有關本次專利訴訟事項的最終結果尚存在不確定性。此外，公司實際控制人及其一致行動人已在公司《首次公開發行並在科創板上市招股説明書》中對公司涉及專利訴訟事項出具承諾：若上述專利訴訟最後形成對公司不利結果，則本人將承擔生效判決結果所認定的應由公司承擔的賠償金或訴訟費用，並向公司補償因上述專利訴訟導致的公司生產、經營損失，以避免公司和公司公眾股東因此遭受任何損失。因此，上述判決結果不會對公司當期財務狀況造成重大不利影響。
此次訴訟事項涉及公司的產品編碼為“MB50R11G”、“HVWA1823”與“MB28H12F”，按照上述產品編碼統計，公司涉訴產品僅在2018年度、2019年度、2020年1-3月進行銷售，累計銷量為25.51萬顆，累計銷售收入為20.60萬元，數量金額非常小。公司上述產品編碼的產品在涉訴後未再進行生產和銷售。
