久其軟件(002279.SZ)：有關上海移通的案件已收到刑事判決書
格隆匯5月12日丨久其軟件(002279.SZ)公佈，公司已收到北京市第一中級人民法院第(2020)京01刑初65號《刑事判決書》。
案件當事人，1、公訴機關：北京市人民檢察院第一分院，2、被吿單位：上海移通網絡有限公司(“上海移通”)，另一被吿單位移通網絡(香港)有限公司(Etonenet (Hong Kong) Limited，“香港移通”)因無訴訟代表人出庭，對該被吿單位中止審理。3、被吿人：葉某、楊某、林某、張某、張某某；4、其他涉案人員：上海移通實際控制人及總經理宦某某、法定代表人黃某某、財務經理王某某、運營總監陶某四人逃匿，另案處理。5、被害單位：北京久其軟件股份有限公司、北京久其科技投資有限公司(“久其科技”)。
案件基本情況：2019年初，公司在對原全資子公司上海移通派駐工作小組實施子公司業務審計時，發現上海移通個別員工存在偽造、私刻客户單位公章的不法行為，同時發現上海移通虛構業務，虛增業績及利潤，存在合同詐騙嫌疑。公司先後收到上海市公安局靜安分局、北京市公安局海淀分局出具的立案通知文件，並對前述案件展開偵查。具體內容詳見公司於2019年2月28日、2019年4月25日和2020年4月16日發佈的相關公吿。
2021年1月12日，北京市第一中級人民法院公開開庭審理了本案。2021年5月12日，北京市第一中級人民法院依法對本案做出一審判決。但截至目前，本案件主要涉案單位及人員香港移通、宦某某、黃某某、王某某、陶某逃匿，尚未歸案。
經依法審理，北京市第一中級人民法院第(2020)京01刑初65號《刑事判決書》，判決主要內容如下：“依照《中華人民共和國刑法》第二百二十四條第(四)及第(五)項、第一百六十四條第一款及第三款之規定、第三十條、第三十一條、第二十五條第一款、第二十七條、第二十三條、六十七條第一款及第二款、第七十二條第一款及第三款、第七十三條、第五十二條、第五十三條第一款、第六十一條以及最高人民法院《關於適用財產刑若干問題的規定》第五條之規定，判決如下：
一、被吿人葉某犯合同詐騙罪，判處有期徒刑五年，並處罰金人民幣五萬元。
二、被吿人楊某犯合同詐騙罪，判處有期徒刑二年，緩刑二年，並處罰金人民幣二萬元。
三、被吿人林某犯合同詐騙罪，判處有期徒刑二年，緩刑二年，並處罰金人民幣二萬元。
四、被吿人張某犯合同詐騙罪，判處有期徒刑二年，緩刑二年，並處罰金人民幣二萬元。
五、被吿單位上海移通網絡有限公司犯對非國家工作人員行賄罪，判處罰金人民幣十萬元。
六、被吿人張某某犯對非國家工作人員行賄罪，判處有期徒刑一年八個月，並處罰金人民幣五萬元。七、北京市人民檢察院第一分院查封、凍結、扣押清單所列的凍結房產及銀行賬户、物品，退回北京市人民檢察院第一分院處理。
如不服本判決，可在接到本判決書的第二日起十日內，通過本院或者直接向北京市高級人民法院提出上訴，書面上訴的，應當提交上訴狀正本一份、副本一份。”
