天瑞儀器(300165.SZ)：收到行政複議調解書 冒用認證標誌一案罰款由90萬元變更為20萬元
格隆匯 7 月 21日丨天瑞儀器(300165.SZ)公佈，近日收到深圳市人民政府《行政複議調解書》(深府行復【2020】130號)(以下簡稱“《調解書》”)。
申請人天瑞儀器不服被申請人深圳市市場監督管理局寶安監管局於2020年1月10日作出的深市監寶罰字【2020】稽7號《行政處罰決定書》，向深圳市人民政府申請行政複議。在案件審理期間，深圳市人民政府根據《中華人民共和國行政複議法實施條例》第五十條、《中共中央政法委員會、最高人民法院、最高人民檢察院、公安部、司法部關於印發<關於政法機關依法保障疫情防控期間復工復產的意見>的通知》(中政委【2020】13號)第十一條的規定，依法組織調解。考慮到在被申請人作出行政處罰前，申請人銷售的部分涉案產品取得了中國環境保護產品認證證書，屬於《中華人民共和國行政處罰法》第二十七條第一款第(一)項所述的主動減輕違法行為危害後果的情形。經深圳市人民政府組織協調，雙方當事人自願達成如下調解協議：
被申請人決定將深市監寶罰字【2020】稽7號《行政處罰決定書》所確定的罰款金額由人民幣90萬元變更為人民幣20萬元。申請人不再提起行政訴訟。
該事項的具體情況：
公司生產銷售的部分涉案水質在線分析儀未取得《環境保護產品認證證書》，卻在銘牌上印製有“中國環境保護產品認證標誌”。涉案產品共銷售10台，銷售單價均為30000元人民幣／台，公司所生產銷售上述產品的貨值金額共計人民幣300000元，無利潤。
深圳市市場監督管理局寶安監管局認為公司未取得《環境保護產品認證證書》生產銷售冒用中國環境保護產品認證標誌“”產品，違反了《深圳經濟特區產品質量管理條例》第二十三條第二款第(六)項“禁止生產、銷售下列產品：(六)偽造或者冒用認證標誌、許可證標誌和編號、國際標準組織標準標誌、質量合格證明、產品批准文號等標誌的”規定，屬於“生產銷售冒用認證標誌產品”違法行為。根據《深圳經濟特區產品質量管理條例》第五十七條“違反本條例第二十三條、第二十五條規定的，由主管部門責令生產者、銷售者停止生產、銷售，沒收違法產品，並處違法生產、銷售產品貨值金額三倍的罰款；有違法所得的，並處沒收違法所得；情節嚴重的，依法吊銷營業執照；涉嫌犯罪的，依法追究刑事責任”的規定，深圳市市場監督管理局寶安監管局決定，責令公司立即改正違法行為，罰款人民幣900000元。
