《本地樓市》中原臨時合約加入「減辣」條款 若無調整則可撤交易及退還訂金

《明報》報道,中原集團旗下中原地產及利嘉閣地產最新就二手買賣提供一份「買賣備忘錄(Subject to Contract)」,提到若《施政報告》公布撤銷或下調額印稅、買家印花稅,或住宅雙倍印花稅調整至少於15%,該份臨時買賣合約才會生效,經紀可在公布後填上合約的生效日期及成交期,並安排把文件及訂金送到指定律師樓。 相反,若《施政報告》無公布有關條件,除非買賣雙方於《施政報告》公布後三日內另外達成協議,否則經紀將會把該份臨約銷毀及退還該張訂金支票予買方,此後雙方各不追究。 施永青回覆傳媒查詢時指,有客人提出相關要求,希望簽訂買賣合約在政府公布撤辣、減辣後才生效,故集團才有所準備,而有關文件須雙方同意才有效。他表示,在其他買賣合約都會出現類似附加條款,只是附加內容不同。 利嘉閣地產總裁廖偉強則指出,有關文件昨日(16日)才交到前線代理,一來保障買家利益,業主不可以在公布減辣後反口,而公司亦不能坐以待斃,待政府公布後才做生意。 地監局表示,不會評論個別事件或個案,但提醒持牌人及消費者,在制訂或簽訂任何協議文件前,必須徵詢法律意見,以免牴觸任何法律或日後發生爭拗。 美聯物業住宅部行政總裁(港澳)布少明亦稱,現時亦研究類似構思,但曾徵詢法律界人士意見後,認為買家簽訂類似備忘錄,有明顯意圖是待公布減辣後以新稅制支付,有機會涉及瞞稅而被稅局追收差價,甚至有機會涉及刑事成分,而如果減辣後樓價飆升,業主亦有機會以不同理由取消交易,最終或涉及法律程序,故暫未有任何決定。
