奧瑞金(002701.SZ)：客户中國紅牛發佈“關於50年《協議書》法院判決有效的聲明”
格隆匯1月2日丨奧瑞金(002701.SZ)公佈，2022年12月30日，公司關注到公司客户紅牛維他命飲料有限公司(“中國紅牛”)在其官方網站上發佈了“中國紅牛關於50年《協議書》法院判決有效的聲明”(“聲明”)，該聲明稱其收到廣東省深圳前海合作區人民法院民事判決書(2019)粵0391民初725號，根據(2019)粵0391民初725號民事判決書認定的有效條款，其依法享有的法定權利為：“只有中國紅牛有權在中國境內生產、銷售紅牛飲料”，泰國天絲及任何第三方負有的法定義務為：“未經書面同意或許可之前，泰國天絲不得在中國境內生產或承包給其它公司生產或銷售紅牛飲料同類產品。”
公司來自客户中國紅牛的銷售額佔比較大，中國紅牛與泰國天絲醫藥保健有限公司之間(“泰國天絲”)的訴訟包括“五十年協議”糾紛案、“1995年合資合同”糾紛案以及與上述兩案密切相關的系列商標權屬、侵權、合資關係、公司治理等糾紛案件的進展可能對公司業務構成重大影響，故向中國紅牛進行了徵詢。現將相關內容公吿如下：
公司針對上述判決情況以及公司與其合作等相關事項進行了徵詢。中國紅牛確認其收到廣東省深圳前海合作區人民法院民事判決書(2019)粵0391民初725號，並認為，根據該判決書只有其有權在中國境內生產、銷售紅牛飲料，其他方均不得在中國境內生產或承包給其它公司生產或銷售紅牛飲料同類產品。此判決從法律上確認了其在協議合作期50年內享有獨家生產、銷售紅牛飲料的權利。同時請奧瑞金依法安排與其雙方合作有關的訴訟工作，繼續與其保持業務協同，按《戰略合作協議》及其他簽訂的購貨合同約定，配合其業務拓展，履行紅牛飲料產品金屬罐供貨及飲料灌裝等合同義務。
公司將積極關注上述事項的進展情況並根據相關規則及時履行信息披露義務，同時繼續按照與中國紅牛之間的戰略合作協議及其技術要求、訂單計劃等履行對中國紅牛供貨和綜合配套服務義務。
