蘇創燃氣(01430.HK)：江蘇騰旭2000萬元存款已根據存款質押合同條款沒收
格隆匯12月15日丨蘇創燃氣(01430.HK)公吿，集團獲吿知，江蘇騰旭於一家銀行擁有的金額為人民幣2,000萬元的存款已根據其與該銀行於2020年12月9日訂立的存款質押合同條款沒收。存款質押合同乃為擔保一名借款人於銀行承兑匯票承兑協議書下的相關責任而訂立，而相關責任未獲履行。於本公吿日期，(i)江蘇騰旭及太倉天然氣質押的銀行存款總額人民幣3.151億元中的約(a)人民幣9,005萬元已被銀行沒收、(b)人民幣105萬元已獲解除及(c)人民幣2.24億元仍處於質押狀態及(ii)太倉天然氣所發出人民幣5,000萬元的承兑匯票將於2021年12月17日到期。
公司已委聘其中國法律顧問就相關交易及被有關銀行沒收的銀行存款提供意見及協助，包括與有關銀行討論集團相關成員公司被沒收存款的可收回性，並以集團相關成員公司名義催促相關借款人償還被有關銀行沒收的款項。
於2021年12月13日，太倉天然氣收到有關銀行的函件，確認於2021年12月8日，上述借款人與有關銀行訂立的總額為人民幣1.42億元的《銀行承兑協議》及八份各自的《流動資金借款合同》已由(i)擔保、(ii)上述金額為人民幣9,200萬元的銀行存款及(iii)第三方提供的不動產的按揭提供擔保。銀行亦確認(i)其將不會向該借款人提供超過現有人民幣1.42億元的額外融資及(ii)倘有關銀行向該借款人提供額外融資，太倉天然氣將不對該額外融資負責。因此，集團預期，其於擔保及為該借款人而與有關銀行訂立的有關存款質押合同下的風險將不會超過上述借款人根據上述《銀行承兑協議》及八份各自的《流動資金借款合同》結欠的總額。
此外，董事會注意到，除日期為2021年9月30日的公吿所披露的存款質押合同外，太倉天然氣於2020年3月至2021年3月已就總額合共為人民幣1.42億元的銀行存款訂立六份存款質押合同。所有該等存款質押合同均已到期，有關第三方借款人已償還相關貸款，且有關銀行並無根據該等存款質押合同沒收存款。
