金禾實業(002597.SZ)：337調查及應訴期間 對公司目前生產、經營不會造成實質性影響
格隆匯 4 月 13日丨金禾實業(002597.SZ)公佈，近日，公司從中國貿易救濟信息網以及美國國際貿易委員會(ITC)網站獲悉：Celanese International Corporation、Celanese (Malta) Company 2 Limited和Celanese Sales U.S.Ltd.(以下合稱“Celanese”)於2021年4月8日根據《美國1930年關税法》第337節規定向美國國際貿易委員會提出調查申請(以下簡稱“本次337調查”)。
Celanese根據《美國1930年關税法》第337節規定向美國國際貿易委員會提出申請，主張對公司及子公司美國金禾等對美出口、在美進口及銷售的特定高甜度甜味劑、製備方法及其下游產品侵犯了其專利權進行調查。
此次337調查涉及的產品為公司生產的甜味劑產品乙酰磺胺酸鉀(“Ace-K”)(“安賽蜜”)，2020年度，公司安賽蜜直接出口美國銷售額佔公司營業收入的比重為1.98%。
公司作為一家高新技術企業，一直堅持自主創新，重視知識產權的管理和保護，在甜味劑產品領域已經進行了多年的研發與生產工作，公司於2006年開始安賽蜜的生產、研發和銷售工作，擁有核心自主知識產權，截止本公吿日，公司已獲取國家知識產權局授權的多項關於甜味劑安賽蜜產品生產的專利，其中11項發明專利、2項實用新型專利。2020年，公司自主研發的“安賽蜜生產工藝優化關鍵技術開發及應用”項目成果獲得安徽省科技進步一等獎，目前公司已成為全球安賽蜜的主要生產商。
2016年11月，Celanese已就乙酰磺胺酸鉀(“Ace-K”)在出口至美國之後的銷售、生產方法以及含有該甜味劑的產品侵犯其專利權事項申請過337調查，通過公司積極應訴，Celanese於2017年3月主動向ITC申請“撤訴並申請終結本案的調查程序”。公司通過主動應訴，切實維護了自身的合法權益，同時使公司對337調查事項積累了豐富的應對經驗和充分的準備，公司有能力也堅信能夠應對本次337調查，堅決維護公司權益，引導行業公平健康發展。
截至目前，公司尚未收到任何正式的法律文書，針對本次337調查，公司高度重視，積極應對相關調查。本次337調查及應訴期間，對公司目前的生產、經營不會造成實質性影響，公司將持續跟進上述事項的進展情況，積極與相關方溝通協商，堅決維護公司及全體股東的合法權益，並根據有關規定及時履行信息披露義務。
