吉華集團(603980.SH)披露蕭然工貿所股份司法拍賣進展
格隆匯2月8日丨吉華集團(603980.SH)公佈，公司於近日收到蕭然工貿發來的《浙江省杭州市中級人民法院執行裁定書》、《浙江省杭州市中級人民法院執行裁定書》獲悉：
1、杭州市中級人民法院對被執行人浙江蕭然工貿集團有限公司持有公司4685.8萬股股票經公開拍賣，其中3347萬股因無人競買而流拍。現申請執行人江海證券有限公司申請將上述流拍股票以一拍保留價2.03億元抵償本案部分債務。
據此，依照《最高人民法院關於人民法院民事執行中拍賣、變賣財產的規定》第二十九條之規定，裁定如下：(一)、將被執行人浙江蕭然工貿集團有限公司持有的公司3347萬股股票作價2.03億元，交付申請執行人江海證券有限公司抵償部分債務。(二)、解除對浙江蕭然工貿集團有限公司持有的公司3347萬股股票的凍結。(三)、申請執行人江海證券有限公司可持本裁定書到相關機構辦理產權過户登記手續、繳納費用。
2、杭州市中級人民法院對被執行人浙江蕭然工貿集團有限公司持有的公司669.4萬股股票在浙江省杭州市中級人民法院淘寶網司法拍賣網絡平台上進行公開拍賣。在第一次公開拍賣中，買受人張珊珊(公民身份號碼330206198307200026)以最高價人民幣4051.54萬元競得，並已付清全部成交價款。
據此，依照《最高人民法院關於人民法院民事執行中拍賣、變賣財產的規定》第二十三條、第二十九條,《最高人民法院關於人民法院民事執行中查封、扣押、凍結財產的規定》第二十八條之規定，裁定如下：(一)、將被執行人浙江蕭然工貿集團有限公司持有的公司669.4萬股股票歸買受人張珊珊(公民身份號碼330206198307200026)所有。(二)、買受人張珊珊可持本裁定到相關部門辦理產權過户登記手續，繳納相關費用。(三)、解除對浙江蕭然工貿集團有限公司持有的吉華集團(證券代碼603980)669.4萬股股票的凍結。
截至本公吿披露日，蕭然工貿持有公司的股份總數為5526.0965萬股(包含5105.8萬股已經司法拍賣成交或已經司法裁定，尚未完成過户手續)，佔公司總股本的7.89%。蕭然工貿目前所持公司股份均被司法凍結，佔其持有公司股份的100%，佔公司總股本的7.89%。本次被司法裁定的股份為蕭然工貿持有的4016.4萬股公司股票，佔公司總股本的5.74%。本次司法裁定不會導致公司的控股股東和實際控制人發生變化。
