泰禾集團(000732.SZ)：因金融借款合同糾紛 被四川信託及浙商金匯信托起訴
格隆匯 1 月 4日丨泰禾集團(000732.SZ)公佈，公司於近日收到《上海金融法院民事起訴狀》(案號為〔2020〕滬74民初1942號)，因金融借款合同糾紛，四川信託有限公司(“四川信託”)向公司及相關當事人提起了訴訟。
公司於近日收到《杭州市中級人民法院民事起訴狀》(案號為〔2020〕浙01民初1944號)，因金融借款合同糾紛，浙商金匯信託股份有限公司(“浙商金匯信託”)向公司及相關當事人提起了訴訟。
案號(2020)滬74民初1942號訴訟的基本情況：
訴訟理由：四川信託於2017年12月26日至2018年1月19日期間，分四期向泰禾集團發放了合計40億元貸款，由泰投投資提供連帶責任擔保，由南京恆祥置業提供抵押擔保，由寧波梅山和南京龍潤提供質押擔保。而後，泰禾集團未能根據貸款合同約定支付剩餘本金和利息，四川信託根據合同約定提起訴訟。
原吿主要訴訟請求：(1)判令泰禾集團償付本金39.95億元及相關利息、罰息等，共計4,797,189,562.20元；(2)判令泰禾投資承擔連帶清償責任；(3)判令南京恆祥置業抵押土地的拍賣、變賣價款在上述債權範圍內優先受償；(4)判令寧波梅山和南京龍潤質押股權的拍賣、變賣價款在上述債權範圍內優先受償；(5)判令被吿共同承擔本案律師費、財產保全擔保費、訴訟費、財產保全費等全部費用。
案號(2020)浙01民初1944號訴訟的基本情況：
訴訟理由：浙商金匯信託於2018年6月25日向上海金閔發放貸款7億元，由泰禾集團、黃其森先生、葉荔女士提供連帶責任擔保(泰禾集團擔保事項詳見2018-143號公吿)。而後，上海金閔未能根據貸款合同約定支付本金和利息，浙商金匯信託根據合同約定提起訴訟。
原吿主要訴訟請求：(1)判令上海金閔償付本金6億元及相關利息、罰息等，共計611,143,052.05元；(2)判令上海金閔承擔律師費及擔保費；(3)判令泰禾集團、黃其森、葉荔承擔連帶清償責任；(4)判令浙商金匯信託對上海金閔名下的在建工程及其對應的土地使用權享有優先受償權；(5)判令被吿共同承擔本案全部訴訟費用。
此次公吿前，公司(包括控股公司在內)除上述相關訴訟外，尚未披露的其他小額訴訟、仲裁事項共計336起，涉及金額174948.13萬元，主要為金額較小的商品房合同糾紛及物業合同糾紛。
