興業礦業(000426.SZ)：子公司銀漫礦業擅自非法佔地進行建設 收到行政處罰決定書
格隆匯 12 月 27日丨興業礦業(000426.SZ)公佈，公司於近日獲悉，公司子公司西烏珠穆沁旗銀漫礦業有限責任公司(“銀漫礦業”)收到了西烏珠穆沁旗自然資源局(“自然資源局”或“我局”)出具的《行政處罰決定書》(西自然資罰決字[2020]5號)，《行政處罰決定書》的主要內容如下：
西烏珠穆沁旗銀漫礦業有限責任公司：
你公司於2020年7月27日，未申請辦理建設用地審批手續，擅自在西烏旗吉仁高勒鎮巴彥烏拉嘎查境內進行礦區建設，該項目建設未申請辦理建設用地審批手續，擅自非法佔地進行建設的行為，涉嫌違反《中華人民共和國土地管理法》第四十四條的規定。
上述違法事實有下列證據證實：1.土地違法案件調查報吿；2.詢問筆錄：3.現場勘測筆錄；4.實地照片；5.現狀圖、規劃圖等資料。
我局已於2020年10月28日依法向你單位進行了吿知（聽證吿知）,你單位在接到《行政處罰吿知書》和《行政處罰聽證吿知書》後，在規定的時間未進行陳述和申辯，也未要求舉行聽證。
根據《中華人民共和國土地管理法》第七十七條、《中華人民共和國土地管理法實施條例》第四十二條和《內蒙古自治區國土資源行政處罰自由裁量權執行標準(試行)》的規定，決定對你單位作出如下行政處罰：
1.責令西烏珠穆沁旗銀漫礦業有限責任公司立即退回非法佔用的土地18.2349公頃。
2.非法佔用土地面積為18.2349公頃(182349平方米)，按照30元/平方米的標準，處以547.0470萬元罰款。
行政處罰履行方式和期限：自收到本處罰決定書15日內繳納至西烏珠穆沁旗自然資源局罰沒款賬户(辦理地點：自然資源局704辦公室)。
該決定送達當事人，即發生法律效力。
你單位如不服本處罰決定，可以在收到本處罰決定書之日起六十日內向西烏珠穆沁旗人民政府或錫林郭勒盟自然資源局申請行政複議，或者六個月內直接向西烏珠穆沁旗人民法院提起訴訟。逾期不申請行政複議，不提起行政訴訟，又不履行本行政處罰決定的，我局將依法申請人民法院強制執行。
銀漫礦業放棄行政複議權利並已接受上述行政處罰；上述行政處罰決定書未對銀漫礦業的生產運營產生重大影響，亦不會對公司業績產生重大影響。
