中信建投證券(06066.HK)與融資人邵秀英達成和解
格隆匯12月24日丨中信建投證券(06066.HK)公告，發行人即公司作為申請人就融資人邵秀英股票質押式回購業務違約事項向北京仲裁委提起仲裁。近日，發行人與融資人邵秀英達成和解，並經北京仲裁委出具（2020）京仲調字第0389號調解書，融資人同意向發行人償還股票質押式回購交易本金52,850,660.22元、相應利息及仲裁費用，且雙方同意發行人對融資人質押給發行人的30,581,679股聯創股份（300343）股票（包括送股、紅利、孳息等）的折價、拍賣或變賣所得價款在上述賠償範圍內優先受償。
此外，發行人作為申請人因融資融券交易糾紛以融資人張克政、保證人高楊為被申請人向北京仲裁委提起仲裁併獲勝訴裁決。近日，發行人向北京市第三中級人民法院對張克政、高楊申請強制執行（（2020）京03執924號），執行中法院執行回款1,103,319.99元，對被執行人採取限制消費措施，目前被執行人暫無其他可供執行財產，北京市第三中級人民法院出具《執行裁定書》，本次執行程序終結。
公告稱，融資人夏傳武於 2017年12月與發行人開展股票質押式回購交易業務，融資金額1.18億元，質押標的為卓翼科技（002369）股票，之後融資人未能按照約定按時回購還款，構成違約（截至違約日，融資人尚待購回本金金額113,847,929.56元，剩餘質押標的股票3,622萬股）。為此，發行人作為申請人以融資人夏傳武為被申請人向北京仲裁委申請仲裁，案件已由北京仲裁委受理，目前正在審理程序中。
此外，發行人全資間接附屬公司北京潤信鼎泰資本管理有限公司及發行人全資子公司中信建投資本管理有限公司作為管理人的私募基金北京潤信鼎泰投資中心（有限合夥）等作為原告，就廣東南方廣播影視傳媒集團有限公司、廣東南方領航影視傳播有限公司股權投資違約事項向廣州市中級人民法院提起訴訟。
近日，本案原告獲得廣東省高級人民法院作出的二審勝訴判決，支持了原告要求被告支付違約金2.4萬元、投資本金4,800萬元及相應費用和違約金的訴訟請求。本案原告已向廣州市中級人民法院申請強制執行，目前正在執行程序中。
