*ST利源(002501.SZ)：法院裁定批准公司重整計劃
格隆匯 12 月 12日丨*ST利源(002501.SZ)公佈，利源精製重整案第一次債權人會議已經於2020年12月11日9:00採取網絡會議方式在“全國企業破產重整案件信息網”召開，本次會議完成了既定議程，並表決通過《重整計劃(草案)》。同日，吉林利源精製股份有限公司重整案出資人組會議表決通過了《吉林利源精製股份有限公司重整計劃之出資人權益調整方案》。
2020年12月11日，管理人向遼源中院提交《裁定批准重整計劃的申請書》。同日，公司收到法院(2020)吉04民破10號《民事裁定書》，裁定批准吉林利源精製股份有限公司重整計劃，並終止吉林利源精製股份有限公司重整程序。
2020年12月11日，利源精製重整案召開了第一次債權人會議，由有財產擔保債權組和普通債權組對重整計劃草案進行了分組表決。由於職工債權和税款債權未受到重整計劃草案的調整或影響，職工債權組和税款債權組不參加重整計劃草案的表決。出席第一次債權人會議有表決權的有財產擔保債權人共1家，其已同意重整計劃草案，已超過該組出席會議債權人的半數；其所代表的債權額佔有財產擔保債權總額的100％，已超過該組債權總額的三分之二；有財產擔保債權組表決通過了重整計劃草案。出席第一次債權人會議有表決權的普通債權人共195家，其中183家債權人同意重整計劃草案，已超過該組出席會議債權人的半數；其所代表的債權額佔普通債權總額的79.84％，已超過該組債權總額的三分之二；普通債權組表決通過了重整計劃草案。
2020年12月11日，利源精製重整案召開了出資人組會議，由出資人對重整計劃草案中涉及的出資人權益調整方案進行了表決。經表決，同意出資人權益調整方案的出資人所代表的表決權佔與會有表決權股份總數的100％，出資人組通過了重整計劃草案涉及的出資人權益調整方案。
2020年12月11日，管理人稱利源精製重整計劃草案已獲得第一次債權人會議各表決組表決通過、且重整計劃草案涉及的出資人權益調整方案已獲得出資人組表決通過，提請本院批准利源精製重整計劃並終止重整程序。
本院認為：法律規定債權人會議在對重整計劃草案分組表決中，各表決組均通過重整計劃草案時，重整計劃即為通過。經審查，利源精製重整計劃草案內容符合法律規定，表決程序合法、有效，已獲得第一次債權人會議各表決組表決通過；該重整計劃符合《中華人民共和國企業破產法》規定的批准條件。依照《中華人民共和國企業破產法》第八十六條第二款規定，裁定如下：
一、批准吉林利源精製股份有限公司重整計劃；
二、終止吉林利源精製股份有限公司重整程序。
本裁定自即日起生效。
