加州上诉庭一致裁定Uber及Lyft司机为雇员 受劳工法例保障
加州上诉法庭法官一致裁定,召车服务公司优步(Uber)及Lyft必须把州内司机视为雇员。加州实施新法例,重定召车、外卖及其他应用程式下提供服务的工人为雇员,可享有失业保险及最低工资保障。
加州5月指控优步及Lyft违反该项新例,法院法官8月指令两间公司把有关人士视作雇员,引来对方不满并要胁将撤出加州,但上诉法庭最终维持原判。法官在74页判词中指,优步及Lyft不当定义为其工作司机的身份为独立外判商,对有司机造成不可弥补损害。纠正有关错误较保护优步、Lyft及其股东更符合公众利益。优步及Lyft表明正考虑上诉。
判决将不会在11月3日前生效,因当地将就零散工地位进行公投。
