中鋁國際(02068.HK)貴陽分公司對華仁公司提起仲裁申請
格隆匯10月19日丨中鋁國際(02068.HK)發佈公告，2017年7月17日，公司貴陽分公司與華仁公司簽訂了《貴州華仁新材料有限公司貴州輕合金新材料退城進園項目（電解鋁部分）工程EPC總承包合同》等相關協議，約定貴陽分公司以EPC工程總承包管理模式實施合同約定的總承包工程，華仁公司按約定支付費用。涉案合同同時約定，除總承包合同之外，華仁公司委託貴陽分公司對退城進園項目有關廠外氧化鋁輸送系統、炭塊轉運站子項工程及其他子項工程進行施工，費用單列，不計入總承包範圍。
貴陽分公司已按約定履行了EPC總承包義務，各子項工程已全部竣工驗收合格並於2019年4月29日全部投產使用，項目至今已全部超過了合同約定的一年質保期限，同時，貴陽分公司墊資完成了涉案合同約定的總承包外的部分工程。
但華仁公司未按約定向貴陽分公司支付工程款及質量保證金等。由於華仁公司在上述合同履行過程中違約，貴陽分公司向位於貴州省貴陽市的貴陽仲裁委員會提起仲裁申請。貴陽仲裁委員會近日出具了《仲裁通知書》，受理了貴陽分公司的仲裁申請。
貴陽分公司就與華仁公司之間的工程總承包合同糾紛，向貴陽仲裁委員會提交仲裁申請書，具體請求內容主要如下：（一）請求裁決華仁公司向貴陽分公司支付總承包合同工程款人民幣20,048.27萬元；（二）請求裁決華仁公司向貴陽分公司支付合同外項目工程款人民幣2,356.87萬元；（三）請求裁決華仁公司向貴陽分公司支付工程質保金人民幣12,733.59萬元；（四）請求裁決華仁公司向貴陽分公司支付延誤付款的資金佔用費人民幣1,651.75萬元；（五）請求裁決華仁公司向貴陽分公司支付工程前期墊資利息人民幣2,151.68萬元；（六）請求裁決華仁公司向貴陽分公司支付貴陽分公司因主張侵權而支出的律師費人民幣150萬元；（七）本案仲裁費華仁公司承擔。
