*ST圍海(002586.SZ)收到民事判決書 哈爾濱中院判決被告償還顧文舉9267萬元本金及相關利息
格隆匯 10 月 15日丨*ST圍海(002586.SZ)公告，近日，公司收到黑龍江省哈爾濱市中級人民法院《民事判決書》(2019)黑01民終1438號，現將具體事項公告如下：
一、本次判決的基本情況
原告：顧文舉
被告：浙江圍海控股集團有限公司、浙江省圍海建設集團股份有限公司等7名
二、《民事判決書》的主要內容：
依照《最高人民法院關於審理民間借貸案件適用法律若干問題的規定》第二十六條、《中華人民共和國合同法》第四十四條、第一百九十六條、第一百九十八條、《中華人民共和國擔保法》第十八條、《中華人民共和國民事訴訟法》第一百五十二條規定，判決如下：
1、被告浙江圍海控股集團有限公司於本判決生效之日起十日內償還原告顧文舉本金9267.11萬元；
2、被告浙江圍海控股集團有限公司於本判決生效之日起十日內償還原告顧文舉借款利息(自2018年8月25日起，以92,671,090.41元，為本金基數，按年利率24%計算，計算至2020年8月19日；2020年8月20日及之後的利息，以92,671,090.41元為本金基數，按中國人民銀行授權全國銀行間同行拆借中心公佈貸款市場報價利率(LPR)四倍的利率計算利息，直至本金、利息還清之日止)；
3、被告浙江圍海控股集團有限公司於本判決生效之日起十日內承擔原告顧文舉因本案所支付的律師代理費310萬元；
4、被告浙江省圍海建設集團股份有限公司等6名對上述借款本金、利息及律師代理費承擔連帶清償責任；
5、駁回原告顧文舉的其他訴訟請求。
一審案件受理費666933.67元，由原告顧文舉承擔66693.37元；由被告浙江圍海控股集團有限公司等7名負擔600240.03元；訴訟保全費5000元，由原告顧文舉負擔。
如被告未按本判決指定的期間履行給付金錢義務，應當依照《中華人民共和國民事訴訟法》第二百五十三條的規定，加倍支付遲延履行期間的債務利息。
如不服本判決，可在判決書送達之日起十五日內，向本院遞交上訴狀，並按對方當事人的人數提出副本，上訴於黑龍江省高級人民法院。
三、本次公告的訴訟對公司的影響
本判決為一審判決，並非終審判決，在訴訟審結之前，對公司本期利潤或期後利潤的影響存在不確定性，公司將根據相關訴訟的進展情況及時履行相應的信息披露義務。
