容百科技(688005.SH)：UMICORE就S6503型產品專利權向公司提起訴訟 涉案金額6203.35萬元
格隆匯 9 月 23日丨容百科技(688005.SH)公佈，近日收到寧波市中級人民法院關於尤米科爾公司(UMICORE)起訴的《民事起訴狀》((2020)浙02知民初313號)等相關材料。截止公告日，該案件尚未開庭審理。
二、訴訟案件的基本情況
1、訴訟當事人
原告：尤米科爾公司(UMICORE)
被告：寧波容百新能源科技股份有限公司
2、事實與理由
原告稱其系第ZL201280008003.9號“具有低可溶性鹼含量的高鎳陰極材料”發明專利的權利人，認為被告S6503型產品的技術特徵與原告發明專利部分權利要求的技術特徵相同，被告未經原告許可，製造、銷售和許諾銷售落入涉案發明專利權保護範圍的產品，構成對原告專利權的侵犯，給原告造成了經濟損失。
3、訴訟請求
(1)判令被告停止製造、銷售、許諾銷售侵犯原告第ZL20128008003.9號發明專利權的產品；
(2)判令被告向原告賠償經濟損失人民幣6192.33萬元；
(3)判令被告向原告賠償為制止侵權行為所支付的合理費用人民幣110167.5元；
(4)判令被告承擔本案的全部訴訟費用。
三、本次公告的訴訟對公司的影響
截止2020年9月23日，公司擁有109項國內外註冊專利，主要涉及三元正極材料產品等。本次公告的訴訟涉及公司產品為公司622系列三元正極材料產品中的S6503型產品，尚未進入商業化量產，因發展戰略等原因已停止開發。
本次公告的訴訟涉及公司產品2019年、2020年1-6月營業收入分別為469356.27元、12514.09元，佔公司當期營業收入的比例分別為0.0112%和0.001%。
公司S6503型產品系公司獨立自主開發的6系三元正極材料之一，非公司核心8系產品，且其工藝與訴訟中的相關內容不一致。若敗訴，公司不能製造、銷售、許諾銷售該產品，並按法院判決執行賠償。本次涉訴產品銷售金額佔公司營業收入比例相對較小，本次訴訟不會對公司持續經營和核心競爭力造成較大不利影響。鑑於本次公告的涉訴案件尚未開庭審理，最終實際影響以法院判決為準。
公司董事會將密切關注和高度重視該事項，積極應訴，依法主張自身合法權益，採取相關法律措施，切實維護公司名譽和股東的利益。
公司保薦機構中信證券股份有限公司正在進行關於出具本次訴訟相關核查意見的內部流程，公司將在收到該核查意見後及時披露。
