華鈺礦業(601020.SH)：控股子公司恆琨冶煉國有建設用地使用權被收回
格隆匯 9 月 22日丨華鈺礦業(601020.SH)公佈，近日，公司收到格爾木市人民政府下發的《格爾木市人民政府關於依法收回西藏恆琨冶煉有限公司國有建設用地使用權的函》(格政函[2020]69號)。
公司控股子公司西藏恆琨冶煉有限公司（以下簡稱“恆琨冶煉”）於2016年12月15日在青海藏青工業園掛牌取得位於藏青工業園兩塊宗地面積分別為585710平方米、1747,620平方米的工業用地，成交價款分別為1475.9892萬元、4404.0024萬元。2016年12月23日，恆琨冶煉與格爾木市自然資源局簽訂格國土掛〔2016〕21號、22號兩宗地的《國有建設用地使用權出讓合同》。由於藏青工業園區在“污染物及重金屬排放總量指標”使用上暫未落實，導致恆琨冶煉項目無法如期獲得環評批覆，不具備辦理不動產權證的條件，不能進行建設施工，恆琨冶煉亦未支付上述兩宗土地的出讓金。
恆琨冶煉於2019年12月18日向格爾木市自然資源局提交《西藏恆琨冶煉有限公司關於終止國有建設用地使用權出讓合同的請示》，申請終止上述《國有建設用地使用權出讓合同》，並免除相應的責任。
鑑於藏、青兩省區環保部門無法配置“污染物及重金屬排放總量指標”，造成該項目遲遲未動工建設，按照《中華人民共和國土地管理法》《閒置土地處置辦法》等相關法律法規規定，格爾木市自然資源局擬終止與恆琨冶煉所簽訂的土地使用權出讓合同，收回上述兩宗土地國有建設用地使用權。
另根據恆琨冶煉收到的西藏自治區藏青工業園區管理委員會下發的《關於保留西藏恆琨冶煉有限公司項目建設用地的函》(藏工管函[2020]4號)相關批示：一、根據《招標拍賣掛牌出讓國有土地使用權規定》“經營性用地應當以招標、拍賣、掛牌方式出讓”相關規定，經格辦(管委會)辦公會議研究，同意終止恆琨冶煉競得的兩宗土地《國有建設用地使用權出讓合同》。二、項目自2015年同意入園以來，恆琨冶煉積極開展各項前期工作，其中可研報告已經專家評審並由西藏自治區經信廳審查(藏工信函[2017]399號)，環評報告也通過專家審查。鑑於此，原則保留原座標系項目規劃用地，待環境容量指標落實，項目具備開工條件後再按相關程序供地。
公司尚未對上述地塊進行實際開發建設，格爾木市自然資源局收回上述國有建設用地使用權，對公司的生產經營不會產生不利影響。
