世纪华通(002602.SZ)：子公司诉前行为保全获法院支持
格隆汇 9 月 13日丨世纪华通(002602.SZ)公布，近日，公司的控股子公司亚拓士软件有限公司(“亚拓士公司”)收到江西省上饶市中级人民法院(“上饶市中院”)寄送的(2020)赣11行保1号《民事裁定书》。
亚拓士公司与娱美德有限公司(“娱美德公司”)为游戏软件《LEGEND OF MIR II》(中文名《传奇》)的共有著作权人。亚拓士公司认为娱美德公司、株式会社传奇IP(“韩国传奇公司”)、娱美德(香港)有限公司(“香港娱美德”)、深圳娱美德传奇科技有限公司(“深圳娱美德”)擅自授权深圳金丰星界科技有限公司(“金丰公司”)运营推广《LEGEND OF MIR II》衍生游戏网站、上饶市佳游网络科技有限公司(“佳游公司”)改编、开发及运营侵权游戏《情义(八一)复古-1.76复古传奇》并在该等网站上推广，侵犯了其合法权益。
鉴于娱美德公司、韩国传奇公司等公司的非法授权行为，亚拓士公司向上饶市中院申请诉前行为保全，请求法院：
1、请求责令第一被申请人娱美德公司、第二被申请人韩国传奇公司、第三被申请人香港娱美德、第四被申请人深圳娱美德及第五被申请人金丰公司自诉前行为保全民事裁定书作出之日起立即停止在中国大陆再行改编网络游戏《LEGEND OF MIR II》(中文名《传奇》)以及直接或间接授权任何第三方再改编网络游戏《LEGEND OF MIRII》(中文名《传奇》)；
2、请求责令第六被申请人佳游公司自本裁定作出之日起立即停止再行改编、开发游戏《情义(八一)复古—1.76复古传奇》；
3、保全申请费用由六被申请人承担。
裁定结果：
1、娱美德公司、韩国传奇公司、香港娱美德、深圳娱美德、金丰公司自本裁定生效之日起立即停止在中国大陆再行改编网络游戏《LEGEND OF MIR II》(中文名《传奇》)以及直接或间接授权任何第三方再改编网络游戏《LEGEND OF MIR II》(中文名《传奇》)；
2、佳游公司自本裁定生效之日起立即停止再行改编、开发游戏《情义(八一)复古-1.76复古传奇》。本裁定立即开始执行。复议期间不停止裁定的执行。
该裁定对本期或期后利润存有积极影响。
根据该裁定，上饶市中院经审查认为：《传奇》游戏相关的《软件许可协议》、《补充协议》、《和解笔录》等相关文件约定了亚拓士公司享有《传奇》游戏在中国大陆独立对外授权的权利，共同著作权人娱美德公司授权亚拓士公司在一定期限内不可撤销的在中国大陆地区行使《传奇》共同著作权人的一切权利。公司的子公司蓝沙信息技术(上海)有限公司(“蓝沙信息”)与亚拓士公司于2017年6月30日签署的《延期协议》约定了新的合同有效期及新的争议解决和管辖法律修订等条款，确认了蓝沙信息对《传奇》游戏的包括改编权在内的相关著作权享有独占性授权。
