瀘天化(000912.SZ)收到瀘州市應急管理局出具的行政處罰告知書
格隆匯 8 月 16日丨瀘天化(000912.SZ)公佈，公司於2020年8月13日收到瀘州市應急管理局出具的《行政處罰告知書》(瀘市)應急罰告[2020]031號。
《告知書》的主要內容：
(一)公司存在的違法行為
1.公司350立方米硝酸銨儲罐頂部未設置有毒有害氣體監測報警裝置；公司350立方米硝酸銨儲罐作為三級重大危險源，該儲罐遠傳温度不能實現報警。
2.公司350立方米硝酸銨儲罐罐頂局部存在明顯氣氨泄漏現象；公司三硝中心控制室硝酸裝置多次出現有毒有害氣體報警裝置聲光報警，但操作人員未及時處置。
(二)行政處罰的證據
《現場檢查記錄》(瀘市應急現檢記〔2020〕支2023號)、《責令限期改正指令書》(瀘市應急責改〔2020〕支2023號)及現場調查取證照片。
(三)行政處罰依據及擬處罰結果
1.根據相關證據，判定“公司350立方米硝酸銨儲罐頂部未設置有毒有害氣體監測報警裝置”的行為構成“未健全重大危險源安全監測監控體系”的違法事實，該事實違反了《危險化學品重大危險源監督管理暫行規定》(原國家安全監督總局令第40號)第十三條第(一)項的規定；依據《危險化學品重大危險源監督管理暫行規定》第三十二條第(三)項的規定和《安全生產行政處罰自由裁量適用規則(試行)》(原國家安全監督總局令第31號)第十三條的規定，擬給予公司處罰款人民幣貳萬伍仟元的行政處罰。
2.根據相關證據，判定“公司350立方米硝酸銨儲罐罐頂局部存在明顯氣氨泄漏現象；公司三硝中心控制室硝酸裝置多次出現有毒有害氣體報警裝置聲光報警，但操作人員未及時處置。”的行為構成“未及時發現、消除事故隱患並如實記錄事故隱患”的違法事實，違反了《中華人民共和國安全生產法》第三十八條第一款的規定；因公司存在多次未如實記錄有毒可燃氣體檢測報警儀報警記錄的違法事實，依據《中華人民共和國安全生產法》第九十四條和《安全生產行政處罰自由裁量適用規則(試行)》第十三條的規定，擬給予公司處罰款人民幣3.5萬元的行政處罰。
3.依據《安全生產行政處罰自由裁量適用規則(試行)》第十條的規定，對公司上述違法行為分別裁量、合併處罰，擬給予處罰款人民幣6萬元的行政處罰。
二、公司採取的措施
1.針對上述行政處罰，公司放棄向瀘州市應急管理局提出陳述申辯或聽證申請。
2.公司於檢查當日針對存在的違法行為，及時安排相關專業、相關人員對存在的問題進行整改，於8月13日完成了違法行為所涉裝置的整改。
3.公司將按內控制度的相關規定嚴肅追究相關人員責任，同時，深刻總結本次行政處罰的教訓，嚴格遵守相關法律、法規，進一步提升規範化運作水平，加強對廠區作業的安全生產管理，杜絕此類事件再次發生。
