樂歌股份(300729.SZ)：美國企業向國際貿易委員會提起對公司開展337調查申請
格隆匯 7 月 23日丨樂歌股份(300729.SZ)公佈，近日，公司從美國國際貿易委員會網站得知，美國Versa Products Inc.依據《美國1930年關税法》第337節規定向ITC提出337調查申請。
此次337調查由美國Versa Products Inc.(“Versa公司”)於2020年7月20日，依據《美國1930年關税法》第337節規定向ITC提出申請，指控 Loctek, Inc.(“美國樂歌”)、Loctek Ergonomic Technology Corporation(“樂歌股份”)和 Zhejiang Loctek Smart DriveTechnology Co.(“樂歌智能驅動”),對美出口、在美進口和在美銷售的高度可調節桌面及其組件(Certain Height-Adjustable Desk Platforms andComponents Thereof)侵犯其專利權(美國註冊專利號10485336)，請求ITC發起337調查，併發布普遍排除令或有限排除令和禁止令。
此次337調查涉及的產品為公司自主研發設計及生產的電動升降台產品，公司出口的升降台產品型號眾多，此次涉訴產品涉及二款型號的電動升降台產品，2018年、2019年及2020年1-6月份上述二款產品在美銷售額佔總銷售額的比重分別為0.05%、0.09%、0.1%；上述二款產品在美銷售額佔公司在美總銷售額的比重分別為0.1%、0.23%、0.27%，所佔比重較小。此次調查不會對公司經營造成實質性影響。
公司作為國家級高新技術企業，一貫重視知識產權的管理和保護，遵守各項知識產權法律法規。公司擁有較大規模的獨立全職專利事務團隊。公司所有產品在新技術實施前，均開展了多重專利排查，以切實防範侵權風險。截止目前，公司在全球共持有800餘項專利，其中發明專利45項。
近年來，中美貿易摩擦不斷，多家美國公司對中國升降台產品啟動337調查。2017年3月30日，Varidesk公司曾針對樂歌升降台產品也向美國國際貿易委員會(USITC)發起337調查申請。2017年8月29日，Varidesk公司與樂歌最終達成和解，樂歌升降台產品繼續出口美國市場。公司主動應訴，切實維護了自身的合法權益，公司對於類似事項具有豐富的應對經驗。
針對此次337調查，公司高度重視，並已成立專項工作組，積極應訴，應對相關調查，堅決維護公司權益，引導行業公平健康發展。
