晨鳴紙業(01812.HK)稱公訴涉案公司為子公司污泥處理外包公司
格隆匯6月18日丨晨鳴紙業(01812.HK)發佈公告，2020年6月17日，網絡上有報道《南昌市人民檢察院對江西晨鳴紙業有限責任公司以及郭某某、李某某等7人以污染環境罪依法提起公訴》的消息，經核查將相關情況説明如下：報道中涉及的案件為山東晨鳴紙業集團股份有限公司控股子公司江西晨鳴紙業有限責任公司污泥處理外包公司2018年6月份以前非法傾倒一般固廢污泥的環保案件。
2018年6月22日，環保督察組對羣眾反映的瓜州村工業污泥傾倒事件進行了現場督察，並確認污泥來源為外包公司非法傾倒所致。案件發生後，該外包公司被確定承擔主要責任，其公司主要涉案人員已被公安機關控制並提起訴訟。另經江西晨鳴核查，江西晨鳴前生產處相關人員龐某等4人（本案涉案人員）與外包公司簽訂固廢處置協議，協議明確約定運出的污泥僅限於用作堆肥，堆肥場地不能對周圍環境造成影響，污泥的運輸與處理必須符合相關法律、法規及環保的要求，由此產生的一切糾紛和費用均由外包公司負責。
在對外包公司的後續管理中，由於上述涉案人員法律意識淡薄，監管不到位，導致未及時上報外包公司的固廢實際處置情況，致使江西晨鳴主要管理層對外包公司非法傾倒行為不知情，延誤了最佳的補救時機。2018年8月30日，南昌市環境保護局給江西晨鳴下發了《行政處罰通知書》，對江西晨鳴做出行政罰款壹拾萬元，公司已在2018年度報告中進行了披露。
由於此案件中外包公司污泥傾倒時間跨度大、污泥鑑定和環境損害評估及修復週期長等原因，致使公安機關反覆補偵，於2020年6月南昌市人民檢察院才對此案件提起公訴。
截止本公告披露日，江西晨鳴生產經營正常，相關涉案人員不涉及公司現任董事、監事和高級管理人員，未對公司及江西晨鳴的生產經營活動造成重大影響。公司將進一步提高環保意識，加強對環境保護法律法規的學習，嚴格遵守、執行環保法律法規，不斷加大環保投入，提升環保治理技術，切實履行環境保護責任。
