天海防務(300008.SZ)：收到法院執行通知書 責令天海防務6月12日前歸還招行借款
格隆匯6月11日丨天海防務(300008.SZ)公佈，天海防務(300008.SZ)公佈，天海防務、江蘇大津重工有限公司、上海佳豪遊艇發展有限公司、上海佳豪船舶科技發展有限公司(以下簡稱“科技發展”)、公司控股股東劉楠於近日收到上海市徐彙區人民法院(以下簡稱“法院”)送達的《執行通知書》[(2020)滬0104執1747號]，系招商銀行股份有限公司上海淮海支行(以下簡稱“招商銀行”)就與公司金融借款合同糾紛案向法院申請執行事宜。
一、案件基本情況
2019年7月9日，公司收到法院送達的《應訴通知書》及《民事起訴狀》，公司於2019年1月23日與招商銀行簽訂了《借款合同》，借款金額為伍仟萬元，實際執行利率為4.35%上浮30%，償還日期為2019年5月21日；2019年2月21日，科技發展與招商銀行簽署《抵押合同》，將名為“佳豪一號”的船舶抵押給招商銀行。因此筆借款公司逾期未還，構成對《借款合同》的違約，招商銀行對天海防務及相關子公司和控股股東、實控人劉楠先生提起民事訴訟。
2019年11月19日，天海防務及相關子公司、劉楠收到法院《民事判決書》，法院判決天海防務向招商銀行償還借款本金42,980,688.83元及相關利息，如不能履行以上付款義務，招商銀行可與科技發展協議，以科技發展名下名為“佳豪一號”的船舶予以折價，或者申請以拍賣、變賣該抵押物所得款項優先受償；抵押物折價或者拍賣、變賣後，其價款超過債權數額的部分歸科技發展所有，不足部分由天海防務繼續清償。天海防務無力及時償付借款本金。
近日，公司收到法院送達的《執行通知書》[(2020)滬0104執1747號]，由於招商銀行與公司金融借款合同糾紛一案的《民事判決書》已發生法律效力，公司未履行相關義務，招商銀行已向法院申請執行。
二、《執行通知書》的相關內容
根據《中華人民共和國民事訴訟法》第二百四十條、《最高人民法院關於適用＜中華人民共和國民事訴訟法＞的解釋》第四百八十二條、《人民法院訴訟收費辦法》第二條的規定，責令天海防務於2020年06月12日之前主動履行法律文書確定的義務，即：支付借款本金42980688.83元，截至2019年7月9日的利息56992.48元、逾期利息1023872.75元；以43037681.31元為基數，按年利率8.4825%的標準計算，自2019年7月10日起至清償之日止的逾期利息；遲延履行利息；執行費暫計111461.55元。
