禾望電氣(603063.SH)：濟南中院判決華電山東物資向公司支付5837萬元本金及利息
格隆匯6月3日丨禾望電氣(603063.SH)公佈，深圳市禾望電氣股份有限公司(以下簡稱“公司”或“原告”)已分別就與瀋陽華創風能有限公司(以下簡稱“瀋陽華創”或“第三人”)、寧夏華創風能有限公司(以下簡稱“寧夏華創”)、通遼華創風能有限公司和青島華創風能有限公司拖欠原告合同款事項向青島市市北區人民法院、青島市中級人民法院提起訴訟，法院已受理(為便於行文，以上訴訟以下簡稱為“前述重大訴訟”)。
前述重大訴訟中寧夏華創應支付公司貨款及保證金64,871,800.00元(包括應收票據款項5,657,100.00元)，對寧夏華創的應收票據款項5,657,100.00元公司已向瀋陽華創的債務人華電山東物資有限公司提起代位權訴訟，故公司在與寧夏華創、瀋陽華創的訴訟中變更訴訟請求金額為人民幣59,214,700.00元。公司於2019年12月19日收到浙江省杭州市中級人民法院關於公司起訴寧夏華創、瀋陽華創買賣合同糾紛案件的一審民事判決書，一審判決支持公司的訴訟請求。
公司起訴寧夏華創、瀋陽華創買賣合同糾紛一案的判決生效後，寧夏華創和瀋陽華創均未按判決指定的期間履行金錢給付義務，公司向瀋陽華創的債務人華電山東物資有限公司(以下簡稱“華電山東物資”或“被告”)提起債權人代位權訴訟，公司於2020年2月11日收到法院關於該債權人代位權案件的受理通知書。
本次訴訟的進展情況：
2020年6月3日，公司收到山東省濟南市中級人民法院(2020)魯01民初694號民事判決書，判決如下：被告華電山東物資有限公司於本判決生效之日起十日內向原告深圳市禾望電氣股份有限公司支付款項本金5837.496萬元及利息(利息以(2018)浙01民初4763號民事判決確定的計算方式為準，即以46,204,560.00元為基數，按中國人民銀行同期貸款基準利率自2018年7月23日起計算至2019年8月19日止的利息及自2019年8月20日起至2019年11月30日止，按全國銀行間同業拆借中心公佈的貸款市場報價利率計算的利息，以58,374,960.00元為基數，自2019年12月1日起按全國銀行間同業拆借中心公佈的貸款市場報價利率計算至實際清償日止的利息)。如果未按本判決指定的期限履行給付金錢義務，應當依照《中華人民共和國民事訴訟法》第二百五十三條之規定，加倍支付遲延履行期間的債務利息。案件受理費345,624.00元，由被告華電山東物資有限公司負擔。
本次公告的訴訟對公司本期利潤或期後利潤等的影響截至2019年12月31日，公司對前述重大訴訟應收賬款已累計計提壞賬準備110,119,290.00元。本公告所述的訴訟判決為一審判決結果，截止本公告披露日該判決尚未生效，後續執行結果尚存在不確定性，故公司無法判斷本次公告的訴訟對本期利潤及期後利潤的影響。公司將按照有關規定，對本次公告訴訟事項的進展情況及時履行信息披露義務。
