杭州銀行(600926.SH)：上海金融法院判決璟合實業向公司上海分行支付11.78億元
格隆匯5月15日丨杭州銀行(600926.SH)公告，近日，公司上海分行收到上海金融法院(2019)滬74民初3459號《民事判決書》。經審理，上海金融法院就公司上海分行與上海璟合實業有限公司等的金融借款合同糾紛一案作出判決。
現將本次訴訟相關進展情況披露如下：
一、本次訴訟進展情況上海金融法院對公司上海分行訴請予以支持，判決如下：
1、被告上海璟合實業有限公司於判決生效之日起十日內向公司上海分行支付借款本金837,252,261.63元、利息215,829,126.09元、罰息70,611,990.76元、複利54,143,302.52元，以及自2019年12月3日起至借款實際清償之日止的逾期還款罰息及複利；
2、被告上海璟合實業有限公司於判決生效之日起十日內向公司上海分行支付律師費90萬元；
3、被告上海祝源企業發展有限公司對被告上海璟合實業有限公司上述1、2項付款義務承擔連帶清償責任，被告上海祝源企業發展有限公司在履行上述義務後，有權向被告上海璟合實業有限公司追償；
4、被告葉羅彬對被告上海璟合實業有限公司上述1、2項付款義務承擔連帶清償責任，被告葉羅彬在履行上述義務後，有權向被告上海璟合實業有限公司追償；
5、被告上海璟合實業有限公司屆期不履行上述1、2項所確定的付款義務的，公司上海分行可以依法與被告上海璟合實業有限公司協議，以抵押物折價或者申請以拍賣、變賣所得價款優先受償，抵押物折價或者拍賣、變賣後，其價款超過債權數額部分歸被告上海璟合實業有限公司所有，不足部分由被告上海璟合實業有限公司繼續清償。如果未按判決指定的期間履行給付金錢義務，應當按照《中華人民共和國民事訴訟法》第二百五十三條規定，加倍支付遲延履行期間的債務利息。本案案件受理費5,930,983.41元，保全費5,000元，均由被告上海璟3合實業有限公司、上海祝源企業發展有限公司、葉羅彬共同負擔。如不服判決，可以在判決書送達之日起十五日內，向上海金融法院遞交上訴狀，並按照對方當事人或者代表人的人數提出副本，上訴於上海市高級人民法院。
二、其他尚未披露的訴訟事項除公司已披露的訴訟事項外，不存在應披露而未披露的其他重大訴訟、仲裁事項。
三、本次判決對公司本期利潤或期後利潤等的影響一審法院判決支持了公司的訴訟請求，但目前該判決尚處於上訴期內，且被告償債能力及抵押物的變現時間仍存在不確定性。公司已對本次訴訟所涉貸款計提相應貸款損失準備，預計本次訴訟事項不會對公司的本期利潤或期後利潤造成重大影響。公司將持續關注本次訴訟的進展情況，保全公司權益，並將繼續按照相關法律法規和監管要求及時履行信息披露義務。
