ST銀億(000981.SZ)：南昌中院駁回南昌銀億房產的上訴 維持原判
格隆匯5月13日丨ST銀億(000981.SZ)公佈，公司全資子公司南昌市銀億房地產開發有限公司(“南昌銀億房產”)於2020年5月12日收到江西省南昌市中級人民法院(“南昌中院”)《刑事裁定書》【(2020)贛01刑終2號】。
案件當事人的基本情況：
1、原公訴機關：南昌市東湖區人民檢察院
2、上訴單位(原審被告單位)：南昌市銀億房地產開發有限公司

案件經過：南昌市東湖區人民法院審理南昌市東湖區人民檢察院指控原審被告單位南昌銀億房產犯對非國家工作人員行賄罪，於2019年11月8日作出(2019)贛0102刑初279號刑事判決：被告單位南昌銀億房產犯對非國家工作人員行賄罪，判處罰金人民幣六百五十萬元。
宣判後，原審被告單位南昌銀億房產不服，提出上訴。上訴單位南昌銀億房產提出其行為不構成對非國家工作人員行賄罪，請求改判無罪。其上訴理由：上訴單位參與、獲得土地競拍的手段和程序均合法，熊小將作為山圖村書記對上訴單位獲得涉案土地不能以法律身份和職務施加任何影響。改變履約保證方式，經山圖村合法程序決議，並由雙方商議而做出調整，均不存在不正當利益。原審判決認定的上訴單位的行賄款項，是涉案項目土地平整、填砂、土地清表工程相關款項，系因被脅迫、欺騙而支付，並非謀求不正當利益而行賄。同時，上訴單位辯護人辯護提出：1.一審法院認定銀億公司謀取“不正當利益”事實不清、證據不足。銀億公司向熊小將付錢是為取得本有的合法權益的被迫行為。2.關於“謀取不正當利益”的法律適用問題。熊小將對涉案地塊沒有職務，沒有規定可違反，沒有為銀億公司提供便利或幫助的基礎和前提。銀億公司沒有違反公正、公平原則，謀取競爭優勢。請求二審法院客觀認定本案事實，並依法改判銀億公司不構成對非國家工作人員行賄罪。
南昌中院於2020年1月3日受理該上訴後，依法組成合議庭，經過閲卷，詢問原審被告單位南昌銀億房產訴訟代表人，聽取辯護人意見，認為本案事實清楚，決定不開庭審理，現已審理終結。
案件最終裁定情況：2020年5月12日，南昌銀億房產收到南昌中院《刑事裁定書》【(2020)贛01刑終2號】，主要內容如下：
本院認為，原審判決認定事實清楚，證據確實充分，適用法律正確，量刑適當，審判程序合法。上訴單位南昌銀億房產的上訴理由及其辯護人的辯護意見，本院不予採納。依照《中華人民共和國刑事訴訟法》第二百三十六條第一款第(一)項之規定，裁定如下：
駁回上訴，維持原判。
本裁定為終審裁定。
