歐比特(300053.SZ)旗下鉑亞信息遭廣州冠盛起訴
格隆匯1月17日丨歐比特(300053.SZ)公佈，公司全資子公司廣東鉑亞信息技術有限公司(“鉑亞信息”)於近日收到了廣州市天河區人民法院出具的《應訴通知書》【案號：(2019)粵0106民初41729號】等相關材料。
經公司初步問詢與調查，李小明在未經鉑亞信息及公司同意的情況下，利用其原為鉑亞信息法定代表人及執行董事的身份與職務便利，在隱瞞了鉑亞信息及公司的情況下，以其本人及鉑亞信息的名義與廣州冠盛企業集團有限公司(“廣州冠盛”)簽訂了《借款合同》，合計借款人民幣7300萬元，其中借款按月利率3%-3.5%計息，部分借款按日利率2‰計息。根據起訴材料，上述借款均由李小明個人收取，其已償還借款500萬元和利息134.4萬元。由於上述借款尚未還清，廣州冠盛將上述糾紛向廣州市天河區人民法院提起訴訟。
被告一為廣東鉑亞信息技術有限公司，被告二為李小明，被告三為陳奕彬；
訴訟請求：(1)判決被告一和被告二立即向原告償還借款本金人民幣6800萬元。
(2)判決被告一和被告二立即向原告支付借款利息約2420.27萬元(以借款本金6000萬元為基數，按月利率2%計算，自2018年2月1日起至實際還清借款之日止，暫計至2019年9月30日；以借款本金800萬元為基數，按月利率2%計算，自2018年12月11日起至實際還清借款之日止，暫計至2019年9月30日)。
(3)判決由被告一和被告二承擔原告為實現本案債權而支出的律師費30萬元。
(4)判決被告三對被告一和被告二上述第(1)、(2)、(3)項請求承擔連帶清償責任。
(5)判決由三被告承擔本案的全部訴訟費用【含案件受理費、保全費等全部為實現債權而產生的司法費用】。
鉑亞信息鄭重聲明：鉑亞信息及公司歐比特對上述借款毫不知情，上述借款均未徵得鉑亞信息及母公司歐比特的同意，未取得鉑亞信息及母公司歐比特任何授權審批文件。上述借款均由廣州冠盛委託的代理人匯入李小明個人賬户，鉑亞信息公司從未向廣州冠盛以如此高利率借取資金。
