浙江龍盛(600352.SH)：法院判決公司等停止對亨斯邁先進材料瑞士所享“偶氮染料及製備方法與用途”發明專利權的侵害等
格隆匯1月7日丨浙江龍盛(600352.SH)公佈，公司於近日收到上海市高級人民法院《民事判決書》【(2015)滬高民三(知)初字第2號】。
公司及控股子公司浙江科永化工有限公司、上海科華染料工業有限公司分別於2015年9月、10月收到上海市高級人民法院(“上海高院”)郵寄的《民事起訴狀》【案號(2015)滬高民三(知)初字第2號】，原告亨斯邁先進材料(瑞士)有限公司向上海市高級人民法院提起民事訴訟，提出以下訴訟請求：
1、判令被告立即停止對原告“偶氮染料及製備方法與用途”專利的侵權行為，包括停止生產、銷售、許諾銷售被控侵權產品；
2、判令被告賠償原告經濟損失人民幣2.3億元；
3、判令被告承擔案件的所有訴訟費用以及原告為制止被告侵權行為而支出的律師費、公證費、鑑定費等合理費用共計人民幣100萬元。

上海市高級人民法院於2019年12月31日出具《民事判決書》【(2015)滬高民三(知)初字第2號】，判決的主要內容如下：
1、被告浙江龍盛集團股份有限公司、浙江科永化工有限公司、上海科華染料工業有限公司、北京德律豐科技有限公司應於本判決生效之日起立即停止對原告亨斯邁先進材料(瑞士)有限公司所享有的“偶氮染料及製備方法與用途”發明專利權(專利號為ZL00106403.7)的侵害；
2、被告浙江龍盛集團股份有限公司、浙江科永化工有限公司、上海科華染料工業有限公司應於本判決生效之日起十日內連帶賠償原告亨斯邁先進材料(瑞士)有限公司經濟損失人民幣1400萬元；
3、被告浙江龍盛集團股份有限公司、浙江科永化工有限公司、上海科華染料工業有限公司應於本判決生效之日起十日內連帶賠償原告亨斯邁先進材料(瑞士)有限公司為制止侵權行為支出的合理費用人民幣30萬元；
4、駁回原告亨斯邁先進材料(瑞士)有限公司的其他訴訟請求。被告浙江龍盛集團股份有限公司、浙江科永化工有限公司、上海科華染料工業有限公司共同承擔案件受理費635,444元以及司法鑑定費88萬元。
如不服本判決，原告亨斯邁先進材料(瑞士)有限公司可以在判決書送達之日起三十日內，被告浙江龍盛集團股份有限公司、浙江科永化工有限公司、上海科華染料工業有限公司可以在判決書送達之日起十五日內，向上海市高級人民法院遞交上訴狀，並按對方當事人的人數提出副本，上訴於中華人民共和國最高人民法院。
此次訴訟涉及的金額佔公司當期資產、利潤的比例非常低；同時，公司及下屬控股子公司早已不再生產和銷售相關爭議產品，因此此次判決對公司正常生產經營不會產生影響。公司將委託代理律師，在判決書送達之日起十五日內，向上海市高級人民法院遞交上訴狀，上訴於中華人民共和國最高人民法院。
