寧波建工(601789.SH)旗下建工集團起訴佳源房產 要求其支付所欠工程款5712萬元及利息等
格隆匯1月6日丨寧波建工(601789.SH)公佈,因寧波佳源房地產開發有限公司(“佳源房產”、“被告”)拖欠公司全資子公司寧波建工工程集團有限公司(“建工集團”、“原告”)工程款,為維護合法權益,建工集團向寧波市鎮海區人民法院提起訴訟,訴請判決佳源房產支付所欠建工集團工程款5712.01萬元及相應利息相關款項等,並請求確認建工集團在工程價款範圍內享有優先受償權。寧波市鎮海區人民法院於近日受理本案。
因案件尚未開庭審理,存在一定不確定性,相關訴訟的各項工作正積極進行,如公司收回該項工程款,則本訴訟對公司本期或期後利潤影響較小,公司將根據案件進展情況按照法律法規及企業會計準則進行相應會計處理。
2016年9月,寧波建工全資子公司建工集團與佳源房產簽訂工程協議,約定由建工集團為佳源房產開發的佳源都市一期項目提供施工總承包服務。2017年5月,建工集團與佳源房產又簽訂了佳源都市二期工程協議,約定由建工集團為佳源房產開發的佳源都市二期項目提供施工總承包服務。協議簽訂後建工集團按約向佳源房產提供了項目施工總承包服務。2019年5月16日,上述佳源都市一期及佳源都市二期項目已取得《房屋建築工程竣工驗收報告》。2019年6月27日,經雙方結算,佳源房產共應向建工集團支付工程款4.6169億元。截止2019年12月被告已支付工程款約3.9423億元,尚欠工程款6745.30萬元(含1033.29萬元保脩金)。
2019年12月,公司子公司建工集團向寧波市鎮海區人民法院提起訴訟,請求:1、判令被告支付工程款5712.01萬元,利息損失41.31萬元,並支付自2019年9月16日起至實際清償之日止以5712.01萬元為基數按全國銀行間同業拆借中心公佈的貸款市場報價利率計算的利息;
2、請求確認建工集團享有建設工程價款優先受償權,即有權在6745.3046萬元(含1033.29萬元保脩金)工程價款範圍內,對鎮海新城鎮海大道佳源都市一期、二期工程的折價或拍賣、變賣所得價款享有優先受償權。
公司子公司建工集團於近日收到寧波市鎮海區人民法院出具的《受理案件通知書》。
