子公司超標排污被罰100萬元 煌上煌(002695.SZ)對處罰結果不服已提請行政訟訴
格隆匯1月3日丨煌上煌(002695.SZ)公佈，公司全資子公司福建煌上煌於近日收到福州市福清生態環境局出具的《行政處罰決定書》(閩榕環罰【2019】449號)。
福州市福清生態環境局對福建煌上煌污水處理設施排放口排放的污水進行取樣監測時發現，福建煌上煌污水處理設施排放口排放污水總磷濃度超過了《污水綜合排放標準》(GB8978-1996)表四中的一級標準。違反了《中華人民共和國水污染防治法》第十條規定。
依據《中華人民共和國水污染防治法》第八十三條和《福州市環境保護行政處罰自由裁量細化標準》(2018年版)第FZ01HB-CF-0072項規定，福州市福清生態環境局對福建煌上煌做出責令立即改正超標排放水污染物的環境違法行為和罰款100萬元的行政處罰。
福建煌上煌得知監測結果後，立即組織了相關部門負責人查明原因並採取了相應的解決措施。經查明，導致排放污水總磷濃度超標的主要原因為使用工業洗滌劑清洗車間地面不當導致。在接到《行政處罰決定書》後，福建煌上煌採取瞭如下主要措施：
1、立即停止使用現有洗滌劑，改為使用無磷型洗滌劑清洗地面。2、添置先進的水樣檢測設備——智能型組合多參數水質測定儀，替換原先的水質檢測設備，加強處理後水樣監測，每天取樣監測。並定期將樣本送第三方檢測機構檢測。3、對自行監測不合格廢水進行迴流污水處理池重新處理，直到自行監測達標後方能排放。4、委託專業公司對污水管網徹底清理和定期清理。
公司向福建煌上煌詳細瞭解受到處罰的經過，公司認為由於福州市福清生態環境局在環境執法的監測項目、採樣監測等存在不規範情形，且根據不交叉執行原則，福建煌上煌應執行行業排放標準《肉類加工工業水污染物排放標準(GB13457-92)》,不應執行綜合排放標準《污水綜合排放標準》(GB8978-1996)。因此，公司已於2020年1月2日向福清市人民法院提請了行政訟訴。
