神農科技(300189.SZ):“七仙嶺神農谷南繁種業國際培訓中心”項目內違建的57棟建(構)築物被沒收
格隆匯1月2日丨神農科技(300189.SZ)公佈,公司全資子公司海南保亭南繁種業高技術產業基地有限公司(“南繁種業”)於2019年12月16日,收到保亭黎族苗族自治縣綜合行政執法局(“本機關”)出具的《行政處罰事先告知書》(保綜法罰告字[2019]第12007號)。
近日收到保亭黎族苗族自治縣綜合行政執法局出具的《行政處罰決定書》(保綜法罰字[2019]第128號),具體情況公告如下:
經查,你(單位)於2013年7月21日在保城鎮七仙嶺毛介村委會排寮村以南75米未取得建設工程規劃許可證擅自開工建設的七仙嶺神農谷南繁種業國際培訓中心項目57棟建(構)築物,分別為:袁隆平工作室1棟(含測繪編號1﹟、60﹟、61﹟),別墅56棟測繪編號4﹟、5﹟、6﹟、7﹟、8﹟、9﹟、10﹟、11﹟、12﹟、13﹟、14﹟、15﹟、16﹟、17﹟、18﹟、19﹟、20﹟、21﹟、22﹟、23﹟、24﹟、25﹟、26﹟、27﹟、28﹟、29﹟、30﹟、31﹟、32﹟、33﹟、34﹟、35﹟、36﹟、37﹟、38﹟、39﹟、40﹟、41﹟、42﹟、43﹟、44﹟、45﹟、46﹟、47﹟、48﹟、49﹟、50﹟、51﹟、52﹟、53﹟、54﹟、55﹟、56﹟、57﹟、58﹟、59﹟,總佔地面積9,586.64平方米,總建築面積11,798.14平方米的行為,違反了《中華人民共和國城鄉規劃法》第四十條的有關規定,依據《中華人民共和國城鄉規劃法》第六十四條的規定。本機關決定對你作出沒收上述“七仙嶺神農谷南繁種業國際培訓中心”項目內違法建設的57棟建(構)築物,總佔地面積9,586.64平方米,總建築面積11,798.14平方米的行政處罰。
如你(單位)不服本處罰決定,可以1、在收到本決定書之日起六十日內向保亭縣人民政府或海南省住房和城鄉建設廳申請行政複議;2、六個月內直接向保亭縣人民法院起訴。
逾期不申請複議或者不向法院起訴又不履行處罰決定的,本機關可以申請人民法院強制執行。
至本公告披露日,公司經營情況正常。南繁種業將申請行政訴訟,最終處理結果存在不確定性,公司將根據該事項的進展情況及時履行信息披露義務。若南繁種業最終被處罰,預計將減少公司2019年淨利潤約1.08億元(最終數據以會計師事務所審計的財務數據為準)。
