莊士中國(00298.HK)：索償人近日收到四川法院索償判決
格隆匯12月12日丨莊士中國(00298.HK)及莊士機構國際(00367.HK)聯合公佈，莊士機構及莊士中國於2016年5月31日及2018年6月1日有關入稟四川法院向中方合作伙伴、甲方、乙方及甲方的配偶(統稱“被告人”)提出該項索償的聯合公佈。
索償人近日收到四川法院有關該項索償的判決，並頒令(i)解除索償人與中方合作伙伴之間就該項目訂立的多項協議；(ii)中方合作伙伴須向索償人支付人民幣1.1077億元(即索償人為該項目投資的原出資款)，連同按照人民銀行同期貸款利率計算的兩倍利息，有關利息由2009年7月1日起直至本金支付完畢之日止；(iii)中方合作伙伴須向索償人支付該項目內的部分租金收入，金額約為人民幣352萬元；(iv)中方合作伙伴須向索償人償還索償人作出的貸款人民幣1005萬元，連同按照人民銀行同期貸款利率計算的利息，有關利息由2007年11月23日起直至本金支付完畢之日止；(v)中方合作伙伴須向索償人償還索償人作出的貸款人民幣1000萬元的49%，連同按照人民銀行同期貸款利率計算的利息，有關利息由2007年11月22日起直至本金支付完畢之日止；(vi)中方合作伙伴須向索償人償還索償人作出的貸款人民幣1090萬元的49%，連同按照人民銀行同期貸款利率計算的利息，有關利息由2009年7月23日起直至本金支付完畢之日止；(上述(ii)至(vi)項下款項統稱為“判決款項”)及(vii)甲方及乙方對上述(ii)項下人民幣1.1077億元及(iv)、(v)及(vi)項下全額債務承擔連帶清償責任。判決亦指出，中方合作伙伴應於判決生效起計30日內支付判決款項。
據莊士中國法律顧問的意見，索償人及被告人均有權對判決提出上訴。倘索償人或被告人於規定期限內未有提出上訴，則判決將會生效。根據索償人作出的估計以作參考用途，按直至2019年12月31日計算的判決款項約為人民幣2.854億元。於2019年9月30日，莊士中國於該項目的總投資成本約為人民幣1.468億元。
於該聯合公佈日期，索償人尚未收到任何通知，亦不知悉任何被告人是否會提出上訴。同時，索償人亦正向其法律顧問尋求有關是否就判決提出上訴的法律意見。
