光威復材(300699.SZ)子公司“拓展”商標受馳名商標保護
格隆匯12月12日丨光威復材(300699.SZ)公佈，公司全資子公司威海拓展纖維有限公司(“異議人”)於2018年6月就名下第4687402號“拓展”商標向國家知識產權局對第24517667號“拓展者TUOZHANZHE”商標提出異議。2019年10月，國家知識產權局審查上述“拓展者TUOZHANZHE”商標異議案件後，下發《第24517667號“拓展者TUOZHANZHE”商標不予註冊的決定》(文書號：【2019】商標異字第0000061301號)，該決定書主要內容如下：
被異議商標“拓展者TUOZHANZHE”指定使用商品為第9類“計算機硬件；已錄製的計算機程序；手機殼；照相機(攝影)；運載工具用導航儀器(隨載計算機)；手機屏幕專用保護膜；音頻揚聲器外殼；擴音器；錄音裝置；揚聲器”等。異議人引證在先註冊的第4687402號“拓展”商標核定適用於第22類“紡織用碳纖維；紡織纖維；紡織品纖維；紡織用玻璃纖維；絲束；纖維紡織原料；塗膠布；網織物；填料；阻燃布”等商品上。本案中，異議人提供的商標註冊證複印件、銷售合同及發票、媒體報道圖片、相關榮譽證書複印件、會計事務所出具的2014-2017年財務報告、税務局出具的2014-2017年納税證明等相關證據材料可以證明：異議人威海拓展纖維有限公司成立於2002年，是專門從事碳纖維及其製品研發與生產的高新技術企業。公司擁有碳纖維行業的全產業鏈佈局，是目前國內生產品種最全、生產技術最先進、產業鏈最完整的碳纖維行業龍頭企業之一。異議人註冊並使用在“紡織用碳纖維；網織物”商品上的第4687402號“拓展”商標經長期使用與宣傳具有較高知名度，為相關公眾所熟知，依據《商標法》第十三條予以保護。被異議商標完整包含異議人商標文字，且未形成明顯有別的其他含義，被異議商標的申請註冊已構成對異議人該商標的模仿，被異議商標如予核准註冊，易誤導公眾，致使異議人的利益可能受到損害。
該決定依據《商標法》第十三條第三款認定威海拓展纖維有限公司名下第4687402號“拓展”商標具有較高知名度、受馳名商標保護。
全資子公司“拓展”商標受到馳名商標保護，有利於維護公司知識產權權益，提升公司品牌知名度與美譽度，進一步增強公司產品的市場影響力和核心競爭力。
