中昌數據(600242.SH)遭創普保理起訴 涉案保理融資本金2800萬元
格隆匯11月25日丨中昌數據(600242.SH)公佈，公司於今日收到上海市浦東新區人民法院發來的《傳票》、《應訴通知書》及創普商業保理(上海)有限公司(以下簡稱“創普保理”、“原告”)遞交上海市浦東新區人民法院的《民事起訴狀》，上海市浦東新區人民法院受理了上述案件並將於2019年12月19日開庭審理。
被告一：中昌大數據股份有限公司；被告二：舟山中昌房地產有限公司；被告三：杭州三盛房地產有限公司；被告四：陳建銘，男，1956年4月29日出生，漢族。被告五：何永祥，男，1984年11月7日出生，漢族。
訴訟請求：
一、請求解除原告與被告一簽訂的《有追索權保理合同》；
二、判令被告一向原告清償保理融資本金人民幣2800萬元；
三、判令被告一向原告清償保理融資利息暫計人民幣35萬元；
四、判令被告一向原告清償逾期利息暫計人民幣75.48萬元(以上述第二項保理融資本金為基數，按照年利率24%的標準，自2019年9月15日起暫計至2019年10月25日，截止2019年10月25日逾期期日為41天)；
五、判令被告一向原告支付本案律師費；
六、判令原告有權以浙江省舟山市定海區臨城街道合興路中昌國際大廈603室房地產拍賣、變賣價款在最高額人民幣4500萬元的範圍內，對上述第二、三、四、五項債權享有優先受償的權利；
七、判令原告有權以杭州市西湖區頤景園綜合樓103室，401室房地產拍賣、變賣價款在最高額人民幣4000萬元的範圍內，對上述第二、三、四、五項債權享有優先受償的權利；
八、判令原告有權以浙江省杭州市富陽區受降鎮頤景山莊綺霞苑21號房地產拍賣、變賣價款在最高額人民幣4500萬元的範圍內，對上述第二、三、四、五項債權享有優先受償的權利；
九、判令原告有權以被告五名下持有的73.34萬股“中昌數據”公司股票(代碼“600242”)拍賣、變賣價款在最高額人民幣4500萬元的範圍內，對上述第二、三、四、五項債權享有優先受償的權利；
十、判令確認上述債權的清償順序為實現債權的費用、逾期利息、保理融資利息、保理融資本金。
十一、本案訴訟費、保全費、擔保費等為實現債權的費用全部由被告承擔。
