光峯科技(688007.SH)訴台達電子專利權權屬糾紛案已獲法院受理
格隆匯11月7日丨光峯科技(688007.SH)公佈，公司就專利號為ZL201610387831.8，“熒光劑色輪及其所適用的光源系統”發明專利(“7831專利”)的專利權權屬糾紛向深圳市中級人民法院遞交起訴狀，目前已獲得深圳市中級人民法院受理，案號為(2019)粵03民初4309號。截至公告日，本案尚未開庭審理。
事實與理由：2019年11月7日，公司以台達電子擅自使用光峯科技的技術方案申請了專利並將王博、張克蘇和華健豪列為發明人，侵害了光峯科技的技術成果以及實際發明人李屹、胡飛的署名權為由，向深圳市中級人民法院提起訴訟。
主要訴訟請求：(1)請求判決專利號為ZL201610387831.8，“熒光劑色輪及其所適用的光源系統”發明專利的專利權歸原告一深圳光峯科技股份有限公司所有；
(2)請求判決確認專利號為ZL201610387831.8，“熒光劑色輪及其所適用的光源系統”發明專利的第一發明人為原告二胡飛，第二發明人為原告三李屹；
(3)請求判令被告在被告官網（www.delta-china.com.cn）和《科技日報》上刊登聲明，向原告二、原告三賠禮道歉；
(4)請求判令被告賠償原告合理支出人民幣30萬元並承擔本案的全部訴訟費。
本案涉及的“7831專利”同時也是訴訟案件(2019)粵73知民初662號案、無效宣告請求案件4W109295號、訴訟案件(2019)京73民初1276號案的涉案專利，前述三項案件具體內容詳見公司2019-005、2019-007、2019-014號臨時公告。此外，台達電子“7831專利”為美國專利US 9,024,241的同族專利，兩者技術方案均來源於US 61/537,687記載的技術方案，公司於美國時間2019年9月6日對台達電子美國專利US9,024,241提出發明人變更為李屹和胡飛請求(案件號：19-cv-00466-RGD-LRL)獲受理，前述案件具體內容詳見公司2019-012號臨時公告及2019年第三季度報告。目前上述案件(“7831專利”相關案件)尚未開庭審理。
若本次案件勝訴，“7831專利”的專利權人將變更為光峯科技，針對台達電子訴訟公司的(2019)粵73知民初662號案和(2019)京73民初1276號案，法院將依據公司請求駁回台達電子的起訴；針對4W109295號無效宣告請求案件，國家知識產權局將依據公司請求結案。
若本次案件敗訴，公司將承擔此案件的訴訟費用，台達電子仍為“7831專利”的專利權人,並且可能會對“7831專利”相關案件產生不利影響。鑑於本次公告的涉訴案件尚未開庭審理，本次訴訟事項對公司本期利潤或期後利潤的影響具有不確定性，最終實際影響以法院判決為準。
