庄士中国(00298.HK)遭合营企业夥伴民事起诉案被驳回
庄士中国(00298.HK)於去年11月接到合营企业夥伴向公司及有关各方提起诉讼,公司接到湖南省高级人民法院的民事裁定书,该民事起诉状已该法院聆讯,并已被驳回起诉,驳回原因为合营企业夥伴向一名并非合营企业监事或合营企业董事会成员的人士提出书面要求,并未履行法律规定的提起股东代表诉讼的前置程序。根据法律,合营企业夥伴有权就上述驳回起诉的裁定提出上诉。
公司正向中国法律顾问寻求法律意见,考虑就合营企业夥伴依据虚假文件进行诉讼等行为,对公司造成的损失及损害提起诉讼及索赔。
