ST天山(300313.SZ)：收到刑事判決書 其中陳德宏被判處無期徒刑，剝奪政治權利終身，並處沒收個人全部財產
格隆匯10月11日丨ST天山(300313.SZ)公佈，公司近日收到昌吉州中院出具的《刑事判決書》【（2020）新 23 刑初7 號】，判決如下：
“本院認為，被吿單位大象廣吿、被吿人陳德宏、陳萬科，以非法佔有為目的在簽訂、履行合同過程中，虛構事實、隱瞞真相，騙取被害單位財物，數額特別巨大，其行為均已構成合同詐騙罪，應依法嚴懲。公訴機關指控罪名成立，應予支持。其中，以發行股份115624607 股用於支付股份對價17.956504 億元，並完成股權登記，屬犯罪既遂，以現金支付對價的5.7679641 億元尚未支付，屬犯罪未遂。陳德宏、陳萬科雖經偵查機關電話傳喚後主動投案，但二人到案後不能如實供述主要犯罪事實，不能認定為自首。本案違法所得，應依法予以追繳，並返還被害單位。綜上，根據大象廣吿、陳德宏、陳萬科的犯罪事實、性質、情節以及社會危害程度，經合議庭合議並報請本院審判委員會討論決定，依照《中華人民共和國刑法》第二百二十四條、第二百三十一條、第三十條、第三十一條、第二十五條第一款、第五十五條第一款、第五十七條第一款、第六十四條之規定，判決如下：
一、被吿單位大象廣吿股份有限公司(現已更名為大象廣吿有限責任公司)犯合同詐騙罪，判處罰金人民幣一千萬元；
(罰金於本判決生效之日起十日內繳納。)
二、被吿人陳德宏犯合同詐騙罪，判處無期徒刑，剝奪政治權利終身，並處沒收個人全部財產；
三、被吿人陳萬科犯合同詐騙罪，判處有期徒刑十五年，剝政治權利五年，並處罰金人民幣三百萬元；
(刑期從判決生效之日起計算。判決執行以前先行羈押的，羈押一日折抵刑期一日，即自2019年1月11日起至2034 年1 月10 日止。罰金於本判決生效之起十日內繳納。)
四、追繳被吿人陳德宏名下的新疆天山畜牧生物工程股份有限公司的股票37279083 股、被吿單位大象廣吿股份有限公司35 名股東與新疆天山畜收生物工程股份有限公司簽訂《發行股份及支付現金購買資產協議》而取得的新疆天山畜牧生物工程股份有限公司的股票 78345524 股，返還被害單位新疆天山畜牧生物工程股份有限公司。
如不服本判決，可在接到判決書的第二日起十日內，通過本院或者直接向新疆維吾爾自治區高級人民法院提出上訴。書面上訴的，應當提交上訴狀正本一份，副本五份。”
此次判決為一審判決，被吿單位、被吿人有上訴權，最終判決、後續執行結果尚存在不確定性，公司將根據案件後續進展情況確認本次判決對公司利潤的影響。
