愷英網絡(002517.SZ)：公司董事、總經理和離任監事分別收到不起訴決定書
格隆匯 12 月 4日丨愷英網絡(002517.SZ)公佈，公司於2020年12月4日獲悉陳永聰先生、林彬先生分別收到上海市人民檢察院第一分院出具的《不起訴決定書》(滬檢一分二部刑不訴[2020]Z5號、滬檢一分二部刑不訴[2020]Z6號)。具體情況公告如下：
1、公司董事、總經理陳永聰因涉嫌操縱證券市場罪接受公安機關調查。後因涉嫌背信上市公司利益罪經上海市人民檢察院批准，被上海市公安局正式逮捕。2020年1月21日，公司收到陳永聰先生的通知，稱其本人已在上海市人民檢察院辦理取保候審手續。具體內容詳見公司於2019年5月20日披露的《關於公司董事、總經理兼財務總監接受公安機關調查的公告》，2019年6月20日披露的《關於公司董事、總經理兼財務總監的進展公告》，2020年1月23日披露的《關於公司董事、總經理取保候審的公告》。
2、公司離任監事林彬因涉嫌背信上市公司利益罪接受公安機關調查。後因涉嫌背信上市公司利益罪，經上海市人民檢察院批准，被上海市公安局正式逮捕。2020年3月4日，公司收到林彬先生的通知，稱其本人已在上海市人民檢察院辦理取保候審手續。具體內容詳見公司於2019年6月10日披露的《關於公司監事辭職的公告》，2019年6月20日披露的《關於公司離任監事接受公安機關調查的公告》，2019年7月26日披露的《關於公司離任監事接受公安機關調查的進展公告》，2020年3月5日披露的《關於公司離任監事取保候審的公告》。
此次進展情況：1、2020年12月4日，陳永聰先生收到上海市人民檢察院第一分院出具的《不起訴決定書》（滬檢一分二部刑不訴[2020]Z5號）。經依法審查查明，認定陳永聰實施背信損害上市公司利益的犯罪事實不清、證據不足，雖經兩次退回補充偵查，仍然證據不足，不符合起訴條件。依據《中華人民共和國刑事訴訟法》第一百七十五條第四款之規定，決定對陳永聰不起訴。
2、2020年12月4日，林彬先生收到上海市人民檢察院第一分院出具的《不起訴決定書》（滬檢一分二部刑不訴[2020]Z6號）。經依法審查查明，認定林彬實施背信損害上市公司利益的犯罪事實不清、證據不足，雖經兩次退回補充偵查，仍然證據不足，不符合起訴條件。依據《中華人民共和國刑事訴訟法》第一百七十五條第四款之規定，決定對林彬不起訴。
