安源煤業(600397.SH)：子公司收到最高人民法院再審的民事裁定書
格隆匯6月2日丨安源煤業(600397.SH)公告，近日，公司接到江煤銷售公司通知，收到最高人民法院再審的民事裁定書。
2017年3月28日，江煤銷售公司因與創豐公司、朝和新能源公司、宣禾能源公司、塗勇斌、趙哲買賣合同糾紛事項向江西省南昌市中級人民法院(以下簡稱南昌市中院)提起訴訟。南昌市中院受理了本案。
訴訟案件事實及請求：
(一)本案事實
2013年9月26日，江煤銷售公司與創豐公司簽訂了《購銷合同》。江煤銷售公司依約履行了義務，創豐公司未如約及時支付貨款。2014年5月9日，雙方進行了對賬，截止2014年4月30日，創豐公司應付江煤銷售公司貨款45700823.32元。朝和新能源公司和宣禾能源公司先後為創豐公司上述付款提供擔保。2014年5月30日，江煤銷售公司與創豐公司、擔保人塗勇斌、擔保人趙哲簽訂了《協議書》，約定了支付所欠江煤銷售公司45700823.32元的時間及違約金，並承擔律師費等。截止起訴日創豐公司應付江煤銷售公司貨款44015823.32元。2017年3月282日，江煤銷售公司將創豐公司、朝和新能源公司、宣禾能源公司、塗勇斌、趙哲訴至南昌市中院。
(二)訴訟請求
1、依法判令被告一創豐公司立即支付所欠原告貨款人民幣44015823.32元(大寫：肆仟肆佰零壹萬伍仟捌佰貳拾叁圓叁角貳分)，並承擔違約金至所有欠款付清時止(截止2017年2月28日違約金為人民幣35540133.87元，大寫：叁仟伍佰伍拾肆萬零壹佰叁拾叁圓捌角柒分)；
2、依法判令被告二、被告三、被告四、被告五對第1項訴訟請求承擔連帶責任；
3、依法判令被告四、被告五承擔本案律師費用人民幣壹拾萬圓正。
4、本案一切訴訟費由全部由上列被告承擔。
一審情況：2018年8月16日，南昌市中院作出(2017)贛01民初123號民事判決：駁回原告江西煤業銷售有限責任公司的訴訟請求。案件受理費439579.78元，保全費5000元，共計444579.78元，由原告江西煤業銷售有限責任公司負擔。
二審情況：本案二審於2019年4月30日在江省高院開庭審理。2019年7月3日，江西省高院作出(2019)贛民終107號民事判決：駁回上訴，維持原判。二審案件受理費475864.74元由江西煤業銷售有限責任公司負擔。本判決為終審判決。江煤銷售公司不服本案二審判決，向最高人民法院申請再審。
再審情況2020年3月27日，最高人民法院作出(2020)最高法民申476號民事裁定：駁回江西煤業銷售有限責任公司的再審申請。
本次公告的訴訟對公司本期利潤或期後利潤等的影響本案已結案。公司基於謹慎性原則，已在以前年度全額計提壞賬準備，對公司本期利潤或期後利潤不會產生影響。
