ST錦港(600190.SH)：收到證監會《行政處罰決定書》
格隆匯11月1日丨ST錦港(600190.SH)公佈，近期收到中國證券監督管理委員會下發的《行政處罰決定書》。錦州港為了做大收入和利潤、滿足銀行貸款需求，與大連和境貿易有限公司(以下簡稱大連和境)、上海銀鴻國際貿易有限公司(以下簡稱上海銀鴻)、寧波朗逸能源有限公司(以下簡稱寧波朗逸)、寧波百榮能源有限公司(以下簡稱寧波百榮)、重慶嶽城川聚貿易有限公司(以下簡稱重慶嶽城川聚)、上海盛轍國際貿易有限公司(以下簡稱上海盛轍)、舟山豐聚益尚能源有限公司(以下簡稱舟山豐聚益尚)等七家公司開展無商業實質的貿易業務。
2018年至2021年，錦州港與上述公司開展貿易業務虛增營業收入、營業成本和利潤總額，導致2018年至2021年年度報吿虛假記載。其中，2018年虛增營業收入2,120,276,859.08元，虛增營業成本2,099,567,800.35元，虛增利潤總額20,709,058.73元。2019年虛增營業收入3,947,122,916.18元，虛增營業成本3,908,124,086.94元，虛增利潤總額38,998,829.24元。2020年虛增營業收入2,481,637,365.23元，虛增成本2,437,479,939.72元，虛增利潤總額44,157,425.51元。2021年虛增營業收入75,113,954.95元，虛增利潤總額75,113,954.95元。
根據當事人違法行為的事實、性質、情節與社會危害程度，依據《證券法》第一百九十七條第二款，我會決定：一、對錦州港股份有限公司責令改正，給予警吿，並處以800萬元罰款；二、對徐健、劉輝給予警吿，並分別處以400萬元罰款；三、對鮑晨欽、李挺、寧鴻鵬給予警吿，並分別處以200萬元罰款；四、對曹成給予警吿，並處以100萬元罰款。
徐健、劉輝違法行為惡劣，違法情節較為嚴重，依據《證券法》第二百二十一條、《證券市場禁入規定》(證監會令第185號)第三條第一項、第七條第一款之規定，我會決定：對徐健、劉輝採取10年市場禁入措施。
