杭州園林(300649.SZ)收到南昌市住房和城鄉建設局行政處罰決定書
格隆匯11月6日丨杭州園林(300649.SZ)公佈，公司於2022年11月4日收到南昌市住房和城鄉建設局出具的《行政處罰決定書》。
由南昌市委巡察辦移送的關於金山大道兩側通道綠化EPC項目涉嫌轉包的問題線索，反映該項目總承包單位杭州園林設計院股份有限公司將項目全部施工內容轉給杭州市市政工程集團有限公司。經立案調查，金山大道兩側通道綠化EPC項目，建設單位是南昌金開項目建設管理有限公司，監理單位是江西鑫鼎建設諮詢監理有限公司，項目總承包中標單位是杭州園林設計院股份有限公司。該項目在實施過程中，總承包單位杭州園林設計院股份有限公司將承包的全部施工工程轉給了杭州市市政工程集團有限公司施工，項目的所有施工內容由杭州市市政工程集團有限公司實施完成。杭州園林設計院股份有限公司作為該項目總承包方，上述行為違反了《中華人民共和國建築法》第二十八條和《建築工程施工發包與承包違法行為認定査處管理辦法》“第八條第一款第（三）施工總承包單位或專業承包單位未派駐項目負責人、技術負責人、質量管理負責人、安全管理負責人等主要管理人員，或派駐的項目負責人、技術負責人、質量管理負責人、安全管理負責人中一人及以上與施工單位沒有簽訂勞動合同且沒有建立勞動工資和社會養老保險關係，或派駐的項目負責人未對該工程的施工活動進行組織管理，又不能進行合理解釋並提供相應的證明的；”之規定，存在轉包工程的行為。
依據《建設工程質量管理條例》第六十二條規定：“承包單位將承包的工程轉包或者違法分包的，責令改正，沒收違法所得，對施工單位處工程合同價款百分之零點五以上百分之一以下的罰款”。
本次沒收違法所得及罰款金額合計為 1,439.82萬元，佔公司2021年度經審計淨利潤的44.08%，佔公司2021年度經審計淨資產的2.71%，將計入公司2022年度當期損益，影響公司2022年度利潤，具體數據以年審會計師出具的審計報吿為準。公司經營情況正常，此次處罰不會對公司後續主營業務及經營業績造成重大影響。
