天邑股份(300504.SZ)：四川監管局擬對實控人之一李躍亨罰沒約2653.15萬元
格隆匯 2 月 21日丨天邑股份(300504.SZ)公佈，公司於2020年9月16日披露了《關於公司實際控制人之一收到中國證券監督管理委員會<調查通知書>的公吿》(公吿編號：2020-085)。公司實際控制人之一李躍亨因涉嫌操縱證券市場，中國證券監督管理委員會決定對其立案調查。
2021年2月20日，李躍亨收到中國證券監督管理委員會四川監管局(“四川監管局”)《行政處罰事先吿知書》(川證監處罰字【2021】1號)，李躍亨因涉嫌違反2005年《證券法》第七十七條第一款第(一)(三)(四)項之規定，構成2005年《證券法》第二百零三條所述操縱市場行為，依據2005年《證券法》第二百零三條的規定，四川監管局擬作出以下決定：沒收李躍亨違法所得13,265,760.63元，並處以13,265,760.63元罰款。
上述擬處罰決定僅為四川監管局對李躍亨的事先吿知，依據《中華人民共和國行政處罰法》第三十二條、第四十二條及《中國證券監督管理委員會行政處罰聽證規則》第五條之規定，針對上述擬處罰決定，李躍亨先生享有陳述、申辯和要求聽證的權利。李躍亨先生提出的事實、理由和證據，經四川監管局複核成立的，四川監管局將予以採納；如果李躍亨放棄陳述、申辯和聽證的權利，四川監管局將按照有關事實、理由和依據作出正式的行政處罰。
四川天邑集團有限公司(“天邑集團”)為公司控股股東，持有公司31.33%的股份，李躍亨未在天邑集團擔任職務，未直接持有公司股份，其通過持有天邑集團34.98%股權間接持有公司股份共計10.96%。從2001年1月公司設立之日起至公吿日，李躍亨未擔任公司任何職務，也不參與公司的日常經營管理，本次李躍亨涉嫌操縱證券市場的行為，不涉及公司資金、不涉及公司股票，上述擬處罰決定僅涉及李躍亨個人，與公司的日常經營管理、業務活動無關，對公司的正常經營不產生影響。公司將根據事項的進展情況及時履行信息披露義務。
