新明中國(02699.HK)擬就支付藍城房產建設委託管理服務費等準備上訴
格隆匯 12 月 1日丨新明中國(02699.HK)公告,於2020年9月8日,經浙江省杭州市拱墅區人民法院一審判決,杭州新明於該判決生效日起十日內支付藍城房產建設管理集團有限公司("原告")應欠委託管理服務費及其員工薪酬福利合計人民幣2468.8萬元,並支付截至2020年3月31日的違約金人民幣1318.75萬元,及自2020年4月1日起至上述款項清償日止的違約金以每日萬分三計算及支付。另外杭州新明需分擔法院案件受理費及其他費用合計人民幣21.74萬元。集團反對該判決並正準備上訴有關工作。
根據於2016年9月雙方簽訂《房地產項目委託管理合同書》,約定委託原告於杭州進行開發建設管理,於雙方完成確認原告所提供的服務程序後,以物業銷售額若干百分比並按合同支付時間支付委託管理服務費及承擔原告員工的薪酬福利。
原告於年內向杭州新明提出訴訟,要求判令杭州新明向原告支付應欠委託管理服務費用、其員工薪酬福利及截至2020年3月31日違約金合計人民幣68,652,422元,同時違約金應具體計算至杭州新明實際償還上述欠款日止,以及要求判令杭州新明承擔案的全部訴訟費用。該案依據中華人民共和國相關法律於2020年4月17日在法院立案,並於2020年8月6日進行公開開庭審訊。
於2020年9月8日,杭州新明正式接到該判決及其內容。集團尋求法律顧問意見後反對該判決並已向杭州市中級人民法院申請上訴。公司相信,上訴成功與否取決於對客觀事實如何認定以及對法律條文的合適引用,上訴結果存在較大不確定性。
