物產中大(600704.SH)：子公司中大租賃與金紹平、徐微微保證合同糾紛一案 已獲法院立案受理
格隆匯 11 月 26日丨物產中大(600704.SH)公佈，2020年11月24日，公司全資子公司浙江中大元通融資租賃有限公司(“中大租賃”)與金紹平、徐微微保證合同糾紛事項，向杭州市中級人民法院提起訴訟。杭州市中級人民法院於2020年11月25日立案受理。
基本案情：2016年6月，原告出資27700萬元入夥杭州惠飛投資管理合夥企業(有限合夥)(“杭州惠飛”)，並由杭州惠飛通過公募基金認購金龍機電股份有限公司2015年非公開發行股份。同時，原告與金龍控股集團有限公司(“金龍控股”)、金紹平、徐微微簽署了《金龍控股集團有限公司、金紹平與浙江中大元通融資租賃有限公司之差額補足協議》。《協議》約定：金龍控股對原告在公募基金結束後收回的本金及收益不足部分進行補足，金紹平及徐微微對金龍控股的全部承諾和保證承擔個人無限連帶責任。
公募基金最終清算後，原告未能按照協議約定收回本息。金龍控股未按約向原告履行差額補足款支付義務。經原告多次催告，兩被告仍未向原告履行保證責任,原告遂於2020年11月24日提起訴訟，並向法院提交財產保全申請。
訴訟請求：1、判令兩被告向原告支付差額補償款項342,044,662.22元。
2、判令兩被告向原告支付自2020年6月5日起的逾期利息(其中至2020年11月16日，以343,430,671.23元為本金按年利率12%(單利)計算的利息18,888,686.92元；自2020年11月17日起至實際支付之日以342,044,662.22元為本金按年利率12%(單利)計算的利息，暫計至2020年11月20日為人民幣456,059.55元，暫合計逾期利息為19,344,746.47元)。
3、判令兩被告承擔原告為本案糾紛支出的律師費人民幣30萬元、保全保險費11.1萬元和保全費5000元。
4、判令本案訴訟費由兩被告承擔。
