中農立華(603970.SH)：子公司廣州立華收到行政處罰決定書 被罰沒1737.62萬元
格隆匯 9 月 24日丨中農立華(603970.SH)公告，公司子公司中農立華(廣州)生物科技有限公司(以下簡稱“廣州立華”)近日收到了廣州市白雲區農業農村局《行政處罰決定書》(穗雲農(農藥)罰【2020】6號)，現將相關情況公告如下：
一、行政處罰內容
廣州立華於2018年11月1日以193.0689萬元的價格將45.057噸限制使用的農藥“力奔百草枯”銷售給中農立華子公司——中農立華廣東生物科技有限公司白雲分公司。廣州立華截至2019年7月31日未取得經營範圍包括限制使用農藥的農藥經營許可證。上述行為被廣州市白雲區農業農村局認定為“超出經營範圍經營限制使用農藥”，依據《農藥經營許可管理辦法》第二十一條第二款、第五十五條第一款第(一)項、第四十六條和第五十八條第(一)項的規定，責令廣州立華立即停止超出經營範圍經營限制使用農藥的行為和按要求執行農藥採購台賬、銷售台賬制度，將超出農藥質量保證期的農藥交由具有危險廢物經營資質的單位進行集中處理，並決定做出如下處罰：
1、沒收違法所得193.0689萬元；
2、處貨值金額(193.0689萬元)8倍罰款：1544.5512萬元。
共計罰沒1737.6201萬元。
二、對公司的影響
新修訂的《農藥經營許可管理辦法》頒佈後，為了解決廣州立華庫存的百草枯經營資質問題，公司決定將廣州立華未銷售完的合法的百草枯內部調劑給獲得限制使用農藥經營資質的中農立華廣東生物科技有限公司白雲分公司進行銷售。上述處罰事項不會對公司當期業績造成重大影響，但對廣州立華的正常生產經營有一定影響，敬請廣大投資者注意投資風險。
三、應對措施
廣州立華將申請對《廣州市白雲區農業農村局行政處罰決定書》進行行政複議或行政訴訟。
公司將認真吸取此次事件的教訓，組織相關單位和部門加強對相關政策法規的學習，加強合規性評估，堅決杜絕此類事件的再次發生。
