晨鳴紙業(000488.SZ)：網絡報道的污染環境公訴事宜未對公司生產經營造成重大影響

案件相關説明：
報道中涉及的案件為山東晨鳴紙業集團股份有限公司(以下簡稱“公司”)控股子公司江西晨鳴紙業有限責任公司(以下簡稱“江西晨鳴”)污泥處理外包公司(以下簡稱“外包公司”)2018年6月份以前非法傾倒一般固廢污泥的環保案件。2018年6月22日，環保督察組對羣眾反映的瓜州村工業污泥傾倒事件進行了現場督察，並確認污泥來源為外包公司非法傾倒所致。案件發生後，該外包公司被確定承擔主要責任，其公司主要涉案人員已被公安機關控制並提起訴訟。另經江西晨鳴核查，江西晨鳴前生產處相關人員龐某等4人(本案涉案人員)與外包公司簽訂固廢處置協議，協議明確約定運出的污泥僅限於用作堆肥，堆肥場地不能對周圍環境造成影響，污泥的運輸與處理必須符合相關法律、法規及環保的要求，由此產生的一切糾紛和費用均由外包公司負責。在對外包公司的後續管理中，由於上述涉案人員法律意識淡薄，監管不到位，導致未及時上報外包公司的固廢實際處置情況，致使江西晨鳴主要管理層對外包公司非法傾倒行為不知情，延誤了最佳的補救時機。2018年8月30日，南昌市環境保護局給江西晨鳴下發了《行政處罰通知書》，對江西晨鳴做出行政罰款壹拾萬元，公司已在2018年度報告中進行了披露。
由於此案件中外包公司污泥傾倒時間跨度大、污泥鑑定和環境損害評估及修復週期長等原因，致使公安機關反覆補偵，於2020年6月南昌市人民檢察院才對此案件提起公訴。
江西晨鳴的整改措施及取得效果：
自案件發生後，江西晨鳴深刻認識自身對外包公司運輸污泥去向和規範化處置監管責任不到位的問題，在對責任人進行嚴肅處理後，第一時間與南昌經開區管委會、南昌市生態環境局對接，在承擔主體責任的外包公司無法有效履行環保整改職責的情況下，江西晨鳴主動擔當，嚴格按法律法規和政府要求迅速開展污泥違規傾倒點污泥無害化處置和生態修復相關工作。在各級政府的指導下，江西晨鳴按時間進度表於2019年12月14日完成污泥無害化處置和傾倒點生態修復工作，並通過了政府相關部門和江西省環保專家驗收評審會。同時，江西晨鳴修訂了嚴格的環保制度，自2018年7月份起，江西晨鳴產生的一般固廢污泥不落地、不外運，全部由自備電廠摻燒，摻燒產生的爐灰、爐渣外運建材單位制作建材並通過檢驗檢測。
對江西晨鳴及公司的影響：
截止本公告披露日，江西晨鳴生產經營正常，相關涉案人員不涉及公司現任董事、監事和高級管理人員，未對公司及江西晨鳴的生產經營活動造成重大影響。公司將進一步提高環保意識，加強對環境保護法律法規的學習，嚴格遵守、執行環保法律法規，不斷加大環保投入，提升環保治理技術，切實履行環境保護責任。
