設研院(300732.SZ)旗下中贇國際所涉工程合同糾紛案已獲法院受理
格隆匯12月24日丨設研院(300732.SZ)公佈，公司控股子公司中贇國際工程有限公司(“中贇國際”或“原告”)就與青海省礦業集團烏蘭煤化工有限公司建設工程合同糾紛於2019年11月20日向青海省海西蒙古族藏族自治州中級人民法院提起訴訟，於2019年12月12日收到青海省海西蒙古族藏族自治州中級人民法院的《受理通知書》【(2019)青28民初128號】。
訴訟當事人：原告為中贇國際工程有限公司，被告一為青海省礦業集團烏蘭煤化工有限公司；被告二為青海省礦業集團股份有限公司
訴訟請求：1、判令解除原告與被告一之間簽訂的《柴達木循環經濟試驗區青海礦業煤基多聯產項目選煤廠工程EPC總承包合同》及其補充協議、《青海礦業800萬噸/年選煤廠配套儲煤場及公輔工程設計施工合同》、《青海礦業800萬噸/年選煤廠配套儲煤場及公輔工程設備採購合同》；
2、判令被告一支付工程欠付款項約3.42億元及利息；
3、判令被告一賠償原告停工窩工造成的損失2068.485萬元及利息；
4、判令被告一返還原告農民工工資保證金及安全風險抵押金共計2000萬元及利息；
5、確認原告就柴達木循環經濟試驗區青海礦業煤基多聯產項目選煤廠工程、青海礦業800萬噸/年選煤廠配套儲煤場及公輔工程享有建設工程優先受償權；
6、判令被告二對被告一應履行的上述債務承擔連帶責任；
7、判令兩被告承擔本案全部訴訟費用。
事實與理由：被告一系被告二於2012年11月19日設立的一人有限責任公司，負責具體實施柴達木循環經濟試驗區青海礦業煤基多聯產項目選煤廠工程、青海礦業800萬噸/年選煤廠配套儲煤場及公輔工程項目。為實施該項目被告一先後與原告簽訂了《柴達木循環經濟試驗區青海礦業煤基多聯產項目選煤廠工程EPC總承包合同》、《青海礦業800萬噸/年選煤廠配套儲煤場及公輔工程設計施工合同》、《青海礦業800萬噸/年選煤廠配套儲煤場及公輔工程設備採購合同》等系列合同，將青海礦業煤基多聯產項目選煤廠工程、配套儲煤場及公輔工程等以EPC形式發包給原告，並向原告收取了農民工工資保證金、安全風險抵押金共計2000萬元。
原告按約定先後完成了設計採購施工內容，被告一卻未按約定進行驗收和付款。2016年8月24日，被告一向原告發函，通知原告項目暫緩建設。2019年5月至今，原告多次向被告一發函，要求被告一對已完工程組織竣工驗收、支付工程款並退還保證金、抵押金。2019年9月30日，被告一回函稱項目復工時間仍未能確定並拒絕驗收項目工程。
截至目前，青海礦業選煤廠、配套儲煤場及公輔工程項目工程等合同內容已經完工，工程欠款高達約3.42億元，二被告經催要均未支付。
