*ST天馬(002122.SZ)收到祥雲小額貸款案起訴狀
格隆匯11月22日丨*ST天馬(002122.SZ)公佈，公司於2018年8月29日披露《關於補充披露公司未入賬借款的公告》，公司與北京祥雲小額貸款有限責任公司(“祥雲小貸”)簽訂了《借款合同》，合同約定公司向祥雲小貸借款人民幣7000萬元，公司關聯公司北京星河世界集團有限公司於2017年9月27日收到祥雲小貸匯入的首筆借款，最終收到共計7000萬元人民幣，該借款已逾期。
近日公司收到了北京市第一中級人民法院送達的案號為(2019)京01民初439號《民事起訴狀》、《傳票》、《應訴通知書》等法律文書，祥雲小貸就其與公司等3名被告的借款合同糾紛一案提起了訴訟。
訴訟請求：1、請求依法判令被告一立即償還原告借款本金人民幣7000萬元及截止到2017年11月22日的利息、違約金人民幣230.66萬元；(其中利息為138.08萬元，違約金為92.58萬元，合計金額為230.66萬元)
2、請求法院依法判令被告一償還原告自2017年11月23日至實際給付之日止的利息及違約金(該項利息及違約金以本金7000萬為基數、按年利率24%標準，自2017年11月23日起計算至實際給付之日止)；
3、請求法院依法判令被告二、被告三對前述第一項訴訟請求、第二項訴訟請求承擔連帶責任。
4、請求依法判令三被告共同承擔本案訴訟費用。
目前該案尚未開庭審理，未來的生效判決結果尚無法定論，但對公司當前正常的生產經營不會產生實質性影響，公司亦將積極應訴。
本案因違規借款引起，根據公司目前控股股東喀什星河創業投資有限公司和實際控制人徐茂棟及其關聯方佔用公司資金金額及還款計劃，公司董事會將在生效司法裁判確定公司負有金錢給付義務日，確認為公司目前控股股東和實際控制人及其關聯方佔用公司資金，並按照生效判決確定的給付義務額本金及罰息、復利、違約金、損害賠償金和延遲支付的利息等項目的計算標準和期間據實予以計算資金佔用額；並根據喀什星河創業投資有限公司、徐茂棟和徐州睦德信息科技有限公司共同出具的一系列承諾函，由承諾人實際履行足額償還義務。
