西伯利亞礦業(01142.HK)及現有董事並非2017年HCA 2077號及HCA 2079號的被告
格隆匯10月3日丨西伯利亞礦業(01142.HK)公佈，該公告乃自願作出，以持續知會股東及潛在投資者有關公司於2013年4月3日發行的可換股票據(“第三批可換股票據”)的進行中訴訟程序的最新情況。
公司日期為2017年5月12日、2017年11月14日及2018年11月2日公告披露，內容有關以下法律訴訟：(i)Daily Loyal Limited針對公司及洪祥準進行的2017年HCA 1071號(“HCA 1071/2017”)；(ii)China Panda Limited及Gold Ocean針 對Daily Loyal Limited及公司進行的2017年HCA 2501號(“HCA 2501/2017”)； 及(iii)Daily Loyal Limited針對公司、China Panda Limited及Gold Ocean進行的2018年HCA 2520號(“HCA 2520/2018”)。
繼於2019年6月24日提交的提前中止訴訟通知後，公司於2019年9月25日收到高等法院作出的經蓋印命令，據此，China Panda Limited及Gold Ocean獲授許可，可全面中止HCA 2501/2017號的原訴訟(“HCA 2501/2017(原訴訟)”)。儘管HCA 2501/2017(原訴訟)中止，但Daily Loyal Limited於HCA 2501/2017內針對China Panda Limited、Gold Ocean及公司提出的反申索(“HCA 2501/2017(反申索)”)亦牽涉有關第三批可換股票據擁有權的類似問題及糾紛，其仍在進行中。
另外，於2019年9月19日，法院指示，Daily Loyal Limited提出對HCA 1071/2017、HCA 2501/2017(反申索)及HCA 2520/2018共同聆訊並由同一法官審判的申請，連同公司及洪祥準提出對兩項其他訴訟，即2017年HCA 2077號及2017年HCA 2079號共同聆訊並由與HCA 1071/2017及HCA 2501/2017(反申索)相同的法官審判的申請(“合併申請”)押後於2019年10月21日作出指示。為免生疑，公司及其現有董事並非2017年HCA 2077號及2017年HCA 2079號的被告。
