ST威龍(603779.SH)：涉及違規擔保案件再審申請獲立案受理
格隆匯2月23日丨ST威龍(603779.SH)公佈，公司對山東省高級人民法院關於違規擔保案件的判決表示不服，於2021年1月19日向最高人民法院關於違規擔保案件申請再審，近日公司通過法院網絡查詢，再審申請已分別於2021年2月20日、2021年2月22日立案受理。
再審申請的主要內容：
涉及煙台銀行股份有限公司龍口支行本金為1億元、5000萬兩起違規擔保案件
再審請求請求：最高人民法院依法撤銷由山東省高級人民法院作出的(2020)魯民終2978號、(2020)魯民終3020號判決書，並重新審理。
主要事實和理由：原二審法院在未對煙台銀行是否“明知”王珍海作為威龍股份法定代表人以威龍股份名義簽署案涉《保證合同》已構成越權代表的事實進行認定的情況下，在未充分考量上市公司對外提供擔保及銀行金融機構接受上市公司擔保的特殊性的情況下，在《九民紀要》已經確立了適用《擔保法司法解釋》第七條的自由裁量權標準的情況下，在《新擔保司法解釋》（徵求意見稿）已經就上市公司對外提供擔保確立了具體裁判規則的情況下，任意行使自由裁量權，直接適用《擔保法司法解釋》第七條並判定威龍股份存在過錯、威龍股份對龍口釀酒不能清償的部分向煙台銀行承擔20%的補充賠償責任，系對本案基本事實認定不清、適用法律錯誤，特請求貴院予以依法撤銷，並重新審理。
涉及華夏銀行股份有限公司煙台龍口支行本金4978萬元的違規擔保案件
再審請求請求：最高人民法院依法撤銷由山東省高級人民法院作出的(2020)魯民終3031號判決書，並重新審理。
主要事實和理由：原二審法院在未對華夏銀行是否“明知”董事會決議系偽造或變造，是否“明知”王珍海作為威龍股份法定代表人以威龍股份名義簽署案涉《保證合同》已構成越權代表的事實進行認定的情況下，在未充分考量上市公司對外提供擔保及銀行金融機構接受上市公司擔保的特殊性的情況下，在《九民紀要》已經確立了適用《擔保法司法解釋》第七條的自由裁量權標準的情況下，在《新擔保司法解釋》（徵求意見稿）已經就上市公司對外提供擔保確立了具體裁判規則的情況下，任意行使自由裁量權，直接適用《擔保法司法解釋》第七條並判定威龍股份存在過錯、威龍股份對龍口釀酒不能清償的部分向華夏銀行承擔30%的補充賠償責任，系對本案基本事實認定不清、適用法律錯誤，請求予以依法撤銷，並重新審理。
